This Act was introduced to address the need for a robust framework to manage and oversee superannuation entities, given the significant role they play in the financial well-being of Australians. The policy objective of the Act is to protect the interests of superannuation fund members by establishing stringent regulatory standards and enforcement mechanisms. The Act was enacted by the Parliament of Australia, reflecting the national importance of superannuation and the need for comprehensive legislative oversight to maintain trust and integrity within the sector. The Act aims to ensure that trustees and responsible officers adhere to the highest standards of conduct and compliance, thereby safeguarding the retirement savings of Australians.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SIS Act) applies to individuals and entities involved in the administration of superannuation entities, such as trustees, investment managers, and custodians. This legislation is designed to protect the interests of superannuation fund members by ensuring that those who manage these funds do so with integrity and competence. The Act applies nationally across Australia, ensuring a consistent regulatory environment for superannuation fund management. The disqualification order under subsection 126A(1) of the SIS Act can be issued if an individual has contravened the Act on one or more occasions, with the nature, seriousness, and number of the contraventions justifying such action. The disqualification is effective from the date of the notice and can be revoked either on the delegate's initiative or upon application by the disqualified person. Furthermore, if a person is dissatisfied with the decision, they may request the Commissioner to reconsider it within 21 days of receiving the notice, providing reasons for the reconsideration. The Act's scope is extended through subordinate instruments, which may provide additional detail on the criteria for disqualification and the procedures to be followed.
