Under subsection 126A(6) of the SISA, a delegate of the Commissioner of Taxation can issue a notice of disqualification to an individual who has contravened the Act. In this particular case, Nicholas Dzian has been issued a notice of disqualification by James O’Halloran, a delegate of the Commissioner of Taxation, under subsection 126A(1) of the SISA, as he is satisfied that Nicholas Dzian has contravened the SISA on one or more occasions, with the seriousness of the contraventions warranting a disqualification. The notice of disqualification imposes certain obligations and requirements on the disqualified individual. Under section 126K of the SISA, it is an offence for a disqualified person who is aware of their disqualification status to act as a trustee, investment manager, or custodian of a superannuation entity, or to be a responsible officer or a body corporate that is a trustee, investment manager, or custodian of a superannuation entity. This means that the disqualified individual is prohibited from participating in any capacity in the management or administration of a superannuation entity.
