NOTICE OF DISQUALIFICATION

Superannuation Industry (Supervision) Act 1993

I, Alison Lendon, a delegate of the Commissioner of Taxation, give you notice as required by subsection 126A(6) of the Superannuation Industry (Supervision) Act 1993 (SISA), that I have made a decision to disqualify you from being, or acting as:

a trustee, investment manager or custodian of a superannuation entity

a responsible officer of a body corporate that is a trustee, investment manager or custodian, of a superannuation entity.

I have disqualified you under subsection 126A(1) of the SISA as I am satisfied that you have contravened the SISA on one or more occasions and the nature and seriousness of the contraventions provides grounds for disqualifying you.

The disqualification order takes effect on the day on which this notice is made.

In accordance with subsection 126A(5) of the SISA, we may revoke this disqualification on our own initiative or on written application made by you.

In accordance with section 344 of the SISA, if you are a person who is affected by this decision and you are dissatisfied with it, you may ask the Commissioner to reconsider this decision. Such a request must be made in writing within 21 days after the day on which you received notice of the decision and must also give the reasons for making the request.

Overview

The Superannuation Industry (Supervision) Act 1993 (SISA) was enacted to regulate the administration and supervision of superannuation funds and entities to protect the interests of fund members. The Act was introduced to address the need for a robust regulatory framework in the superannuation industry, ensuring compliance and safeguarding the financial well-being of superannuation fund members. The SISA was enacted by the Parliament of Australia and its policy objective is to maintain high standards of financial management and ethical conduct within the superannuation industry. The Act provides mechanisms for disqualifying individuals from certain roles within superannuation entities if they are found to have contravened the provisions of the Act, ensuring that those entrusted with managing superannuation funds are fit and proper persons.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals and entities involved in the management of superannuation funds, including trustees, investment managers, and custodians, as well as responsible officers of corporate bodies performing these roles. This Act is of national application across Australia, extending its jurisdictional reach to both Commonwealth and state levels. The Act targets the conduct and transactions related to superannuation entities to ensure compliance with regulatory standards designed to protect the interests of superannuation fund members. While the primary focus is on the disqualification of individuals found to have contravened the Act, the scope also includes the potential for revocation of such disqualifications under certain conditions. Exclusions or exemptions from the Act are limited, with the primary mechanism for non-application being the absence of contravention of its provisions. The Act may extend or restrict its application through subordinate instruments, although the primary text of the legislation itself outlines the core provisions and penalties associated with non-compliance.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SISA) provides the framework for the disqualification of individuals or entities involved in the management of superannuation entities. Under section 126A(6), the Commissioner of Taxation or their delegate, in this case Alison Lendon, can disqualify a person from acting as a trustee, investment manager or custodian of a superannuation entity, or as a responsible officer of a body corporate that holds such roles. The decision to disqualify Mrs Hava Isiklar was made because it was determined that she contravened the SISA on one or more occasions, and the seriousness of these contraventions justified her disqualification (subsection 126A(1)). The obligations imposed by the Act on the parties governed by it are primarily concerned with the proper management and oversight of superannuation funds. Trustees, investment managers, custodians, and responsible officers of body corporates must adhere to the provisions of the SISA to ensure the integrity and security of the superannuation system. This includes compliance with the legislative requirements regarding the investment, administration, and reporting of superannuation funds. Failure to meet these obligations can lead to enforcement actions, including disqualification. The consequences for breaching the SISA can be severe, particularly if the contraventions are serious enough to warrant disqualification. Section 126A(6) of the SISA allows for immediate disqualification from the roles specified, which effectively removes the individual from any involvement in managing superannuation entities. This disqualification order takes effect on the date the notice is made, as seen in the notice to Mrs Isiklar dated 2 October 2014. Furthermore, the notice of disqualification will be published in the Gazette as per subsection 126A(7) of the SISA. Additionally, the Commissioner has the authority to revoke the disqualification on their own initiative or upon a written application by the disqualified person, in accordance with subsection 126A(5) of the SISA. If Mrs Isiklar is dissatisfied with the decision, she may request a reconsideration by the Commissioner within 21 days of receiving the notice, as outlined in section 344 of the SISA.
