Overview

The Superannuation Industry (Supervision) Act 1993 (SISA) was enacted to address issues within the supervision of the superannuation industry, aiming to protect superannuation fund members by ensuring that trustees, investment managers, and custodians act in the best interests of members. The Act provides the framework for the regulation and oversight of superannuation entities and their officers. The SISA was enacted by the Australian Parliament and aims to maintain the integrity and stability of the superannuation industry by disqualifying individuals who are deemed unfit to manage superannuation funds. In the specific case of Mr. Scott Logan, he has been disqualified from acting as a trustee, investment manager, or custodian of a superannuation entity, or as a responsible officer of a body corporate performing these roles, due to a determination that he is not a fit and proper person under the provisions of the Act. This disqualification is effective immediately from the date of the notice, and provisions exist for potential revocation or reconsideration of this decision.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals and entities involved in the management and oversight of superannuation entities, including trustees, investment managers, and custodians, as well as responsible officers of corporate bodies that perform these roles. The Act extends its jurisdiction nationally, ensuring compliance across all states and territories of Australia. This notice specifically targets Mr Scott Logan from Torquay, Victoria, who has been disqualified from acting in any capacity related to the management of superannuation entities. The disqualification arises from a determination that Mr Logan is not a fit and proper person to hold such positions, as required by the Act. The disqualification order is effective immediately upon the issuance of this notice. Furthermore, the Act provides for the potential revocation of such disqualifications and allows for reconsideration of the decision by the Commissioner if Mr Logan, or any other affected party, is dissatisfied with the outcome. This notice also indicates that the details of the disqualification will be published in the Gazette, in line with the provisions of the Act.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SISA) provides mechanisms for the disqualification of individuals from certain roles within the superannuation industry. In this case, under section 126A(6) of the SISA, a delegate of the Commissioner of Taxation has issued a notice of disqualification to Mr Scott Logan. The notice informs Mr Logan that he is disqualified from acting as a trustee, investment manager or custodian of a superannuation entity, or as a responsible officer of a body corporate involved in such roles. This decision is made pursuant to section 126A(3) of the SISA, which allows for disqualification if it is determined that the individual is not a fit and proper person to hold such a position. The obligations and requirements imposed by the SISA in this instance include ensuring that all trustees, investment managers, custodians, and responsible officers are deemed fit and proper to manage superannuation entities. The Act mandates that a delegate of the Commissioner of Taxation can disqualify an individual if there is sufficient evidence that they do not meet these standards. Once a disqualification order is made, it takes immediate effect as stated in the notice. In terms of the consequences for breach, the SISA does not explicitly state penalties for non-compliance with disqualification orders. However, the disqualification itself can have significant professional and personal repercussions for the individual, as it bars them from participating in the management of superannuation entities. Additionally, under section 344 of the SISA, if Mr Logan is dissatisfied with the decision, he has the right to request the Commissioner to reconsider the decision in writing within 21 days of receiving the notice. If the disqualification is later revoked, it can be done so either on the initiative of the delegate or upon a written application from Mr Logan, as outlined in section 126A(5) of the SISA.
