NOTICE OF DISQUALIFICATION

Superannuation Industry (Supervision) Act 1993

 

To:

MR FINBARR PETER DOWLING

ESSENDON NORTH 3041

I, Alison Lendon, a delegate of the Commissioner of Taxation, give you notice as required by subsection 126A (6) of the Superannuation Industry (Supervision) Act 1993 (SISA), that I have made a decision to disqualify you from being, or acting as:

a trustee, investment manager or custodian of a superannuation entity

a responsible officer of a body corporate that is a trustee, investment manager or custodian, of a superannuation entity.

I have disqualified you under subsection 126A (1) of the SIS Act as I am satisfied that you have contravened the SISA on one or more occasions and the nature and seriousness of the contraventions provides grounds for disqualifying you.

 

The disqualification order takes effect on the day on which this notice is made.

Note 2:

In accordance with subsection 126A (5) of the SIS Act, we may revoke this disqualification order on our own initiative or on written application made by you.

Note 3:

In accordance with section 344 of the SIS Act, if you are a person who is affected by this decision and you are dissatisfied with it, you may ask the Commissioner to reconsider this decision. Such a request must be made in writing within 21 days of the day on which you received notice of the decision and must also give the reasons for making the request.

 

 

 

Overview

The Superannuation Industry (Supervision) Act 1993 was enacted by the Parliament of Australia to provide a regulatory framework for the oversight and supervision of the superannuation industry. This Act was introduced to address the need for a comprehensive and enforceable system to protect the interests of superannuation fund members by ensuring that trustees, investment managers, and custodians operate with integrity and competence. The primary policy objective of the Act is to maintain the stability and reliability of the superannuation system, thereby safeguarding the retirement savings of millions of Australians. One significant aspect of the Act is its provision for disqualifying individuals who have contravened its provisions from acting in key roles within the superannuation industry. The disqualification mechanism is intended to deter misconduct and uphold the high standards required in the management of superannuation funds.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals and entities involved in the management and administration of superannuation funds in Australia, including trustees, investment managers, custodians, and responsible officers of corporate trustees, investment managers, or custodians. The Act is a Commonwealth legislation and therefore applies nationally across Australia. The Act aims to protect the interests of superannuation fund members by ensuring that those managing these funds do so with integrity and competence. The Act includes provisions for disqualification of individuals found to have contravened its provisions, as evidenced in the notice issued to Mr. Finbarr Peter Dowling. The notice specifies that Mr. Dowling has been disqualified from acting in specified roles within the superannuation industry due to contraventions of the Act, with the disqualification taking immediate effect. The Act also provides mechanisms for the revocation of such disqualification orders and the reconsideration of decisions by the Commissioner. Key Provisions

Section 126A (6) provides the mechanism for notifying an individual, in this case Mr. Finbarr Peter Dowling, that they have been disqualified from acting as a trustee, investment manager, or custodian of a superannuation entity, or as a responsible officer of a body corporate that holds such roles. This disqualification is imposed when the Commissioner of Taxation, through a delegate such as Alison Lendon, is satisfied that the individual has contravened the SISA and the nature and seriousness of these contraventions justify the disqualification. Under Section 126A (1) of the SISA, the disqualification takes immediate effect upon the issuance of the notice. Mr. Dowling has been informed that he is disqualified from the aforementioned roles as of the date of the notice, which is 22 August 2014. Furthermore, as per Section 126A (7) of the Act, details of this disqualification will be published in the Gazette to ensure transparency and public awareness. The notice also indicates that the disqualification order can be revoked either by the Commissioner on their own initiative or following a written application from Mr. Dowling, in accordance with Section 126A (5) of the SISA. In the event that Mr. Dowling wishes to contest the disqualification, Section 344 of the SISA provides a recourse. He may request the Commissioner to reconsider the decision in writing within 21 days of receiving the notice. This request must include the reasons for the reconsideration. Failure to comply with these provisions or to address the underlying contraventions could result in ongoing disqualification and potentially further penalties as stipulated by the SISA.
