Overview

The Superannuation Industry (Supervision) Act 1993 was enacted to address the need for regulation and oversight of the superannuation industry in Australia, aiming to protect the interests of superannuation fund members. The Act provides a framework for the supervision and regulation of superannuation funds, including provisions for the disqualification of individuals deemed unfit to manage or oversee these funds. Enacted by the Commonwealth Parliament, the policy objective of the Act is to ensure that superannuation entities are managed in a manner that safeguards the financial interests and retirement security of members. This notice of disqualification under the Act serves to highlight the serious consequences for individuals who fail to meet the fit and proper person requirements, thereby reinforcing the legislative intent to maintain high standards of integrity and competence within the superannuation industry.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals and entities involved in the supervision and management of superannuation entities, specifically targeting trustees, investment managers, custodians, and responsible officers of such entities. This Act has a Commonwealth reach, applying across Australia, and its provisions are designed to ensure that those managing superannuation funds do so with integrity and in the best interests of fund members. The Act includes provisions for disqualifying individuals deemed unfit to manage superannuation entities, as evidenced by the disqualification of Mr Daniel Askin. The disqualification is effective immediately upon notification, and the decision can be reviewed or revoked under specific provisions of the Act. Furthermore, certain particulars of such disqualifications are published in the Gazette, ensuring transparency and public accountability. The Act provides avenues for affected individuals to seek reconsideration of the decision within a stipulated timeframe, reinforcing its commitment to due process and fairness.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SISA) includes provisions that allow for the disqualification of individuals from certain roles within the superannuation industry. Section 126A(6) of the Act mandates that a delegate of the Commissioner of Taxation must notify an individual when they have been disqualified from being a trustee, investment manager, custodian, or a responsible officer of a body corporate involved in these roles. This section ensures that the affected parties are formally informed of the decision. Under section 126A(3) of the SISA, a disqualification can be imposed if the delegate is satisfied that the individual is not a fit and proper person to hold such positions. The notice provided to Mr Daniel Askin (subsection 126A(6)) indicates that he has been disqualified from being a trustee, investment manager, custodian, or a responsible officer of a body corporate involved in these roles. The disqualification order comes into effect on the date the notice is made. The Act also outlines specific obligations for the parties involved. For instance, under section 344, an affected individual has the right to request the Commissioner to reconsider the disqualification decision. This request must be made in writing within 21 days of receiving the notice of the decision, and must include the reasons for the request. Additionally, the Act mandates that particulars of the disqualification notice will be published in the Gazette as per subsection 126A(7). Furthermore, the disqualification can be revoked either on the initiative of the delegate or upon a written application from the disqualified individual, as stipulated in subsection 126A(5). In terms of consequences, the Act imposes both civil and potential criminal penalties for breaches related to disqualification. While the specific penalties are not detailed in the provided excerpt, such breaches could potentially result in significant fines or imprisonment, depending on the severity and nature of the breach. The Act's stringent measures are designed to maintain the integrity and reliability of the superannuation industry.
