Overview

The Superannuation Industry (Supervision) Act 1993 (SISA) was enacted to provide a regulatory framework for the supervision of superannuation entities in Australia, aiming to protect the interests of superannuation fund members. The Act was introduced to address issues and gaps in the regulation of the superannuation industry, ensuring that trustees, investment managers, and custodians of superannuation entities adhere to stringent standards of conduct and compliance. The SISA was enacted by the Commonwealth Parliament, with the overarching policy objective of safeguarding the financial well-being of superannuation fund members and maintaining the integrity of the superannuation system. The Act empowers the Commissioner of Taxation to disqualify individuals who contravene its provisions, as evidenced by the disqualification of Krista Melamies-Potaka under subsection 126A(1) of the SISA. The disqualification serves as a deterrent against non-compliance and reinforces the regulatory oversight of the superannuation industry.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals and entities involved in the administration and management of superannuation entities, including trustees, investment managers, custodians, and responsible officers of superannuation funds. The Act has a national jurisdictional reach, applying throughout Australia and regulating the conduct of those involved in the superannuation industry. The disqualification notice under subsection 126A(6) of the SISA is issued to an individual, in this case Krista Melamies-Potaka, who has been found to have contravened the provisions of the SISA, leading to a disqualification from performing specific roles within the superannuation industry. The disqualification takes immediate effect and is subject to potential revocation under subsection 126A(5) of the SISA. Additionally, it is an offence for a disqualified person to act in any capacity specified under section 126K, with a maximum penalty of two years imprisonment. Should the affected individual wish to contest the disqualification, they can request a reconsideration of the decision within 21 days of receiving notice, as outlined in section 344 of the SISA.

Key Provisions

The notice from the delegate of the Commissioner of Taxation, Emma Rosenzweig, under subsection 126A(6) of the Superannuation Industry (Supervision) Act 1993 (SISA), informs Krista Melamies - Potaka of her disqualification as required by subsection 126A(1). The notice specifies that the disqualification is due to her contravention of the SISA on one or more occasions, with the seriousness of these contraventions justifying the disqualification. This disqualification takes immediate effect from the date of the notice, which is 17 February 2023. In accordance with subsection 126A(7) of the SISA, details of this disqualification will be published in the Commonwealth Government Notices Gazette. Under section 126K of the Act, it is an offence for a disqualified person, who is aware of their disqualification, to act as a trustee, investment manager, or custodian of a superannuation entity, or to be a responsible officer or a body corporate that is a trustee, investment manager, or custodian of a superannuation entity. The maximum penalty for committing this offence is two years in jail. Moreover, subsection 126A(5) of the SISA allows for the possibility of the disqualification being revoked either on the initiative of the Commissioner or following a written application by the disqualified person. If Krista Melamies - Potaka is dissatisfied with the decision, she can request the Commissioner to reconsider the decision within 21 days of receiving the notice, as stipulated by section 344 of the SISA, and provide reasons for why she believes the decision is incorrect.
