Overview

The Superannuation Industry (Supervision) Act 1993 was enacted by the Commonwealth Parliament to address the need for oversight and regulation within the superannuation industry to ensure the protection of superannuation funds and the rights of members. This legislation was introduced to fill a gap in regulatory frameworks governing superannuation entities, aiming to prevent misconduct and ensure the integrity of the superannuation system. The Act provides the Commissioner of Taxation with powers to disqualify individuals from certain roles within superannuation entities if they have contravened the provisions of the Act in a manner deemed serious enough to warrant such action. The policy objective is to safeguard the financial interests of superannuation fund members by maintaining high standards of conduct and governance within the industry. This notice of disqualification issued to Mrs Kirsty Reiersen under the Act highlights the enforcement mechanisms available to uphold these standards.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SIS Act) applies to individuals and entities involved in the supervision of superannuation entities, including trustees, investment managers, and custodians. The Act mandates that any person found to have contravened its provisions on one or more occasions may be disqualified from performing certain roles within the superannuation industry. The geographic reach of the SIS Act is national, applying across Australia, including the Commonwealth, states, and territories. The disqualification applies to Mrs Kirsty Reiersen, who has been found to have contravened the SIS Act, leading to her immediate disqualification from being a trustee or a responsible officer of a body corporate involved in the management of superannuation entities. The disqualification takes effect on the date the notice is issued. The Act also provides mechanisms for revocation of the disqualification order and the right to request reconsideration of the decision within 21 days of receiving notice. Any particulars of the disqualification notice will be published in the Gazette as required by the SIS Act.

Key Provisions

The notice provided to Mrs Kirsty Reiersen by Ivan Parrett, a delegate of the Commissioner of Taxation, informs her of a disqualification order made under the Superannuation Industry (Supervision) Act 1993 (SIS Act). The operative section in this notice is subsection 126A(6), which mandates that a person must be given notice of a disqualification order (subsection 126A(6)). The decision to disqualify Mrs Reiersen stems from subsection 126A(1), which allows for disqualification if there is a contravention of the SIS Act and the seriousness of the contravention warrants such action. The notice informs her that the disqualification is effective from the date of the notice, 6 March 2013. The SIS Act imposes specific obligations and requirements on Mrs Reiersen, prohibiting her from acting as a trustee or a responsible officer of any body corporate that functions as a trustee, investment manager, or custodian of a superannuation entity. This prohibition arises from the disqualification order, which is a direct consequence of her contraventions of the SIS Act. The notice also mentions that details of the disqualification will be published in the Gazette as per subsection 126A(7), ensuring transparency and public notification of such decisions. Under the SIS Act, there are potential legal consequences for breach of its provisions. The disqualification order itself is one such consequence, effectively barring Mrs Reiersen from certain professional roles within the superannuation industry. Additionally, there may be civil or criminal penalties for the contraventions that led to the disqualification. While the notice does not specify the penalties, the SIS Act generally provides for significant fines and imprisonment for serious breaches of its provisions. For instance, subsection 126A(4) indicates that a person who contravenes certain sections of the Act can be subject to substantial fines, and in severe cases, imprisonment. The notice also clarifies that the Commissioner may revoke the disqualification order on his own initiative or upon a written application by Mrs Reiersen. Furthermore, she has the right to request a reconsideration of the decision within 21 days of receiving the notice, as outlined in section 344 of the SIS Act.
