Overview

The Superannuation Industry (Supervision) Act 1993 (SIS Act) was enacted by the Commonwealth Parliament to regulate the superannuation industry and ensure the proper management and protection of superannuation funds. This Act was introduced to address the need for stringent oversight and regulation within the superannuation sector, aiming to prevent misconduct, mismanagement, and fraud that could adversely affect the financial security of individuals' retirement savings. The policy objective of the SIS Act is to maintain the integrity of the superannuation system by enforcing high standards of conduct and compliance among trustees, investment managers, and custodians of superannuation entities. The Act provides mechanisms for disqualifying individuals from participating in the management of superannuation funds if they are found to have contravened the law in a manner that warrants such action, thereby protecting the interests of superannuation fund members.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SIS Act) applies to individuals and entities involved in the management and oversight of superannuation funds, including trustees, investment managers, and custodians. This Act imposes significant regulatory requirements to ensure the proper management and integrity of superannuation entities. The disqualification provision outlined in the Act allows for the barring of individuals from performing roles such as trustees or responsible officers if they have contravened the Act, particularly when the nature and seriousness of the contraventions warrant such a measure. This disqualification applies nationally across Australia, reflecting the Commonwealth's role in regulating superannuation to protect the interests of beneficiaries. The Act extends its application through subordinate instruments, which may detail specific criteria or additional conditions for disqualification. Exclusions or exemptions from the Act are limited and generally pertain to certain types of superannuation entities or specific circumstances outlined in the legislation or related regulations.

Key Provisions

The notice of disqualification provided under subsection 126A(6) of the Superannuation Industry (Supervision) Act 1993 (SIS Act) serves to inform Miss Katie Elaine Russell of her disqualification from serving as a trustee or responsible officer for entities that manage superannuation funds. This disqualification is effective immediately upon the issuance of the notice, as stated in the document dated 10 October 2013. The decision to disqualify Miss Russell has been made by Ivan Parrett, a delegate of the Commissioner of Taxation, who found that she had contravened the SIS Act on one or more occasions, warranting such a serious measure due to the nature and seriousness of the contraventions. The SIS Act imposes several obligations on trustees and responsible officers, including the duty to act in the best interests of the fund members, to comply with the Act, and to ensure proper management and administration of the superannuation entity. Miss Russell, by being disqualified, is no longer permitted to engage in these roles. This disqualification extends to her inability to act as a trustee or a responsible officer of any body corporate that operates as a trustee, investment manager, or custodian of a superannuation entity, as outlined in the Act. Breaching the requirements of the SIS Act can result in severe consequences, including disqualification from holding certain roles within superannuation entities. The notice informs Miss Russell that her disqualification is effective immediately, and the decision can be reviewed by the Commissioner if she chooses to request reconsideration within 21 days of receiving the notice. Furthermore, under subsection 126A(7) of the SIS Act, particulars of this disqualification will be published in the Gazette, ensuring transparency and public notification of the decision. Additionally, the disqualification order can be revoked either on the initiative of the delegate or upon a written application from Miss Russell, as per subsection 126A(5) of the SIS Act.
