Overview

The Superannuation Industry (Supervision) Act 1993 (SISA) was enacted to regulate and supervise the superannuation industry in Australia, addressing the need for consistent and effective oversight of superannuation funds. The Act aims to protect the interests of superannuation fund members by ensuring that trustees and other responsible officers adhere to the highest standards of governance and conduct. The Act was enacted by the Parliament of Australia and its policy objective is to maintain the integrity of the superannuation system, ensuring that funds are managed responsibly and in the best interests of members. In the case of Jordan Von Nida, a disqualification notice was issued under the Act, reflecting the serious nature of the contraventions by the corporate trustee of one or more superannuation entities, for which Von Nida was a responsible officer at the time. This action underscores the importance of compliance with the SISA to maintain the trust and confidence of superannuation fund members.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 applies to trustees, responsible officers, and other individuals involved in the management and administration of superannuation funds within Australia. This includes corporate trustees and their responsible officers who are subject to the Act's provisions on the proper management and operation of superannuation entities. The Act has a Commonwealth reach, governing superannuation funds across Australia. Exclusions and exemptions are typically defined within the Act itself or through subordinate instruments, but specific exclusions are not detailed in the disqualification notice. The Act allows for the extension or restriction of its application through subordinate instruments, which can provide additional definitions, rules, and penalties. The disqualification of an individual such as Jordan Von Nida under subsection 126A of the Act is a serious matter, indicating a breach of the Act's provisions by the corporate trustee of a superannuation entity while the individual was a responsible officer. Such a disqualification is intended to protect the integrity of the superannuation system and the interests of superannuation fund members.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SISA) includes provisions for the disqualification of individuals who have been responsible officers of corporate trustees that have contravened the Act. In this case, Jordan Von Nida has been disqualified under subsection 126A(2) of the SISA (paragraph 1). This disqualification was made effective immediately upon the notice being issued, as per subsection 126A(6) (paragraph 2). The disqualification will also be published in the Commonwealth Government Notices Gazette as required by subsection 126A(7) (Note 1). Under the SISA, Jordan Von Nida is now prohibited from acting as a trustee, investment manager or custodian of a superannuation entity, or being a responsible officer or a body corporate that is a trustee, investment manager or custodian, of a superannuation entity. This prohibition is outlined in section 126K (Note 2). If Jordan Von Nida were to violate this prohibition, it would be considered an offence with a maximum penalty of two years imprisonment (Note 2). The disqualification can be revoked by the delegate of the Commissioner of Taxation, either on their own initiative or upon Jordan Von Nida's written application, as per subsection 126A(5) (Note 3). If Jordan Von Nida is dissatisfied with the disqualification decision, they can request the Commissioner to reconsider the decision in writing within 21 days of receiving notice of the decision, as outlined in section 344 (Note 4). This request must include the reasons why Jordan Von Nida believes the decision is incorrect.
