Overview

The Superannuation Industry (Supervision) Act 1993 (SIS Act) was enacted by the Parliament of Australia to regulate and oversee the administration of superannuation funds. This legislation was introduced to address the need for stringent governance and compliance within the superannuation industry to protect the interests of superannuation fund members. The Act provides the framework for the establishment of the Australian Prudential Regulation Authority (APRA) and the Australian Taxation Office (ATO) to supervise and enforce compliance with superannuation laws. The primary policy objective of the SIS Act is to ensure that superannuation funds are managed efficiently, transparently, and in the best interests of members, thereby maintaining public confidence in the superannuation system. The Act aims to prevent misconduct and incompetence among trustees and responsible officers by providing mechanisms for disqualification where necessary.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SIS Act) applies to individuals and entities involved in the superannuation industry, including trustees, investment managers, and custodians of superannuation entities. This Act imposes obligations on these entities to ensure the proper management and administration of superannuation funds. The disqualification provisions under section 126A of the SIS Act allow for the disqualification of individuals from acting as trustees or responsible officers if they have contravened the Act in a manner that warrants such a penalty. The geographic reach of the Act is national, applying across all states and territories in Australia. Exclusions or exemptions from disqualification are not explicitly stated in the notice, but the Act provides pathways for reconsideration and revocation of such orders under specific conditions. The application and scope of the Act can be extended or clarified through subordinate instruments, which may detail additional criteria or processes for enforcement.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SIS Act) contains provisions for disqualifying individuals from certain roles within superannuation entities, such as being a trustee or a responsible officer. Specifically, subsection 126A(6) mandates that a delegate of the Commissioner of Taxation must provide a written notice to the individual detailing the decision to disqualify them from these roles. This decision is based on a finding that the individual has contravened the SIS Act in a manner that warrants disqualification. The disqualification order, as outlined in subsection 126A(1), becomes effective on the date the notice is issued. Under the SIS Act, entities that are trustees, investment managers, or custodians of superannuation funds are required to adhere to strict regulatory standards to ensure the proper management and protection of superannuation funds. Individuals holding positions of responsibility within these entities must comply with the legislative requirements set forth in the SIS Act. Failure to do so can result in severe consequences, including disqualification from holding such positions. The obligations placed on the parties governed by the SIS Act include maintaining transparency, acting in the best interests of the fund members, and adhering to the regulatory frameworks designed to safeguard the financial well-being of superannuation fund members. The SIS Act includes provisions for both civil and criminal penalties for breaches of the legislation. Under subsection 126A(7), particulars of any disqualification notice will be published in the Gazette, serving as public notification of the disqualification. Furthermore, the Act allows for the potential revocation of the disqualification order, either initiated by the Commissioner or upon written application by the disqualified individual. Section 344 of the SIS Act provides a recourse for individuals who are dissatisfied with the decision to disqualify them, allowing them to request a reconsideration by the Commissioner within 21 days of receiving notice of the decision. This request must be made in writing and include the reasons for the reconsideration.
