Overview

The Superannuation Industry (Supervision) Act 1993 (SISA) was enacted by the Australian Parliament to address the need for robust regulation and oversight of the superannuation industry. This legislation aims to protect the interests of superannuation fund members by imposing obligations on trustees, investment managers, and custodians of superannuation entities. One of the key provisions of the SISA is the ability to disqualify responsible officers who engage in misconduct or allow serious contraventions to occur. The notice of disqualification issued to Antoinette Shirvington under this Act highlights the enforcement mechanism available to ensure compliance and maintain the integrity of the superannuation system. The policy objective is to deter improper conduct and maintain public confidence in the superannuation industry by holding responsible officers accountable for their actions.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 (SISA) applies to individuals who are responsible officers of corporate trustees within the superannuation industry, as well as to the corporate trustees themselves and their operations. The geographic reach of the Act is national, as it is a Commonwealth Act, thereby extending its application across all states and territories of Australia. The Act imposes a disqualification on individuals who are responsible officers when the corporate trustee they are associated with breaches the Act, with the seriousness of the contraventions determining whether disqualification is warranted. This disqualification prohibits the individual from acting or being involved in any capacity, such as trustee, investment manager, or custodian, of a superannuation entity, with significant penalties for non-compliance. The Act also allows for the disqualification to be revoked under certain conditions and provides a process for reconsideration of the decision by the Commissioner if the affected individual is dissatisfied with the outcome.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SISA) provides for the disqualification of individuals who have been responsible officers of a corporate trustee and have been involved in contraventions of the Act (section 126A). The disqualification notice to Antoinette Shirvington under subsection 126A(6) informs her that she has been disqualified due to the corporate trustee's contraventions of the SISA, and she was a responsible officer at the time. The disqualification takes immediate effect (subsection 126A(7)). The notice also indicates that the details of this disqualification will be published in the Commonwealth Government Notices Gazette (Note 1). The SISA imposes specific obligations on the parties it governs, including responsible officers of corporate trustees. These officers must ensure compliance with the Act to avoid disqualification. Additionally, under section 126K, it is an offence for a disqualified person to act as a trustee, investment manager, or custodian of a superannuation entity, or to be a responsible officer of a body corporate that is a trustee, investment manager, or custodian, if they are aware of their disqualification status. The maximum penalty for committing this offence is two years in jail. The Act also outlines the consequences for breaches. Firstly, under subsection 126A(5), the disqualification can be revoked either on the initiative of the Commissioner of Taxation or upon a written application from the disqualified person. Secondly, if Antoinette Shirvington is not satisfied with the decision, she has the right to request a reconsideration from the Commissioner within 21 days of receiving the notice. This request must be in writing and include the reasons she believes the decision is incorrect (section 344).
