Overview

The Superannuation Industry (Supervision) Act 1993 was enacted to address the need for regulation and oversight of the superannuation industry in Australia. This legislation was introduced to ensure the proper management and administration of superannuation entities, aiming to protect the interests of superannuation fund members and maintain the integrity of the superannuation system. The Act was enacted by the Parliament of Australia, reflecting the policy objective of safeguarding the financial well-being of superannuation fund members by regulating the activities of trustees, investment managers, and custodians within the industry. The Act provides mechanisms for the disqualification of individuals who have contravened its provisions, as demonstrated in the notice of disqualification issued under the authority of the Act.

Scope and Application

The Superannuation Industry (Supervision) Act 1993 applies to trustees, responsible officers, and entities involved in the management or custody of superannuation funds within Australia. This legislation encompasses individuals or bodies corporate that are trustees, investment managers or custodians of superannuation entities. Its jurisdiction extends nationally, with the Act being a Commonwealth statute, thereby impacting entities and persons across all states and territories within Australia. The Act aims to ensure the proper management and supervision of superannuation funds to protect the interests of fund members. As per the notice of disqualification, individuals such as Mr. Anthony Ginn can be disqualified from holding positions of trust or responsibility in relation to superannuation entities if there are contraventions of the Act. The disqualification order is immediate upon the issuance of the notice. The Act provides mechanisms for the revocation of such disqualification orders and avenues for reconsideration of the decision by the Commissioner of Taxation, as detailed in the notice.

Key Provisions

The Superannuation Industry (Supervision) Act 1993 (SIS Act) is central to the regulation of superannuation funds in Australia. Specifically, section 126A(6) provides the Commissioner of Taxation or their delegate the authority to disqualify an individual from holding positions such as trustee or responsible officer within entities that manage superannuation funds. In this instance, Mr. Anthony Ginn has been notified under subsection 126A(6) that he has been disqualified from such roles following a decision made by Ivan Parrett, a delegate of the Commissioner of Taxation. This disqualification was determined due to Mr. Ginn’s contraventions of the SIS Act, as outlined in subsection 126A(1). The decision to disqualify was based on the nature and seriousness of these contraventions, which warranted such a measure. The notice informs Mr. Ginn that the disqualification order is effective immediately from the date of the notice, which in this case is 22 January 2013. The Act imposes several obligations on individuals and entities governed by it. Trustees, investment managers, and custodians of superannuation entities must adhere to the provisions of the SIS Act to maintain their roles. Contraventions of the Act can lead to severe consequences, including disqualification. Furthermore, under subsection 126A(7), the particulars of this disqualification are to be published in the Gazette to ensure transparency and public awareness. Additionally, the Act allows for the potential revocation of the disqualification order, either initiated by the Commissioner or by a written application from the disqualified individual, as stipulated in subsection 126A(5). Mr. Ginn also has the right to request a reconsideration of the decision within 21 days of receiving the notice, as per section 344 of the SIS Act. Breaching the provisions of the SIS Act can lead to significant legal consequences. The disqualification itself is a substantial penalty, prohibiting the individual from participating in the management of superannuation funds. Furthermore, the Act does not specify particular criminal or civil penalties for the contraventions that led to the disqualification in this case, but it is clear that such breaches are taken seriously and can result in severe administrative sanctions. The overarching aim of these measures is to protect the interests of superannuation fund members and ensure the integrity of the superannuation system.
