Overview

The Maritime Transport and Offshore Facilities Security Act 2003 was enacted to address the need for improved security measures at designated maritime transport and offshore facilities in Australia. This Act was introduced by the Australian Parliament to ensure the protection of critical infrastructure and to safeguard the nation's maritime interests. The policy objective of the Act is to establish a framework for the security of ports and offshore facilities, which includes the designation of port operators who are responsible for implementing and maintaining security measures in line with the Act's requirements. The Act aims to prevent potential security threats and ensure the safety and efficiency of maritime transport operations. This legislative measure is critical for maintaining the integrity of Australia's maritime borders and protecting its economic interests.

Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 applies to the regulation of security within Australia's maritime transport and offshore facilities, focusing on the designated port operators and their responsibilities to ensure security measures are met. This Act applies to entities such as Far North Queensland Ports Corporation Limited, which has been designated as a port operator for the security regulated port of Port of Karumba. The legislation encompasses the geographic scope of Australia and its territories, thereby extending its jurisdictional reach across the Commonwealth. Notably, the Act does not specify particular exclusions or exemptions but may include thresholds or requirements for designation and revocation of port operators through subordinate instruments, as evidenced by the revocation of Queensland Ports Corporation and the designation of Far North Queensland Ports Corporation Limited. This Notice, which revokes a previous designation and assigns a new operator, demonstrates the flexibility and administrative capacity of the Act to adapt to changing operational requirements within the maritime sector.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) is a significant piece of legislation that governs the security of maritime transport and offshore facilities in Australia. Under section 14(1) of the Act, the Director, Transport Security Operations, Office of Transport Security, has the authority to designate port operators for security-regulated ports. This particular Notice, issued by Robert Pugsley, revokes the designation of Queensland Ports Corporation as the port operator for the Port of Karumba and designates Far North Queensland Ports Corporation Limited in its place. The Notice is effective from its publication in the Gazette, as stated in Line 15 of the Notice. The obligations imposed by the Act on the parties it governs are primarily focused on ensuring the security of maritime transport and offshore facilities. Designated port operators, such as Far North Queensland Ports Corporation Limited, are required to implement and maintain security measures in accordance with the regulations and guidelines set out in the Act. This includes developing and enforcing a port facility security plan, conducting regular security assessments, and coordinating with relevant authorities to ensure the effective implementation of security measures. Additionally, the Act requires designated port operators to report any security incidents or breaches to the appropriate authorities without delay. Failure to comply with the provisions of the Maritime Transport and Offshore Facilities Security Act 2003 can result in both civil and criminal consequences. Under section 24 of the Act, any person who contravenes a provision of the Act is liable to a civil penalty of up to $100,000 for a corporation and $20,000 for an individual. Furthermore, under section 25, any person who commits an offence against the Act is liable to a criminal penalty of up to five years imprisonment or a fine of up to $300,000 for a corporation and $60,000 for an individual. These penalties are intended to deter non-compliance and ensure the effective enforcement of the Act. In summary, the Maritime Transport and Offshore Facilities Security Act 2003 designates Far North Queensland Ports Corporation Limited as the port operator for the security-regulated port of Port of Karumba. The Act imposes obligations on the designated port operator to implement and maintain security measures in accordance with the regulations and guidelines set out in the Act. Failure to comply with the Act can result in civil and criminal penalties, including fines and imprisonment. The Notice revoking the designation of Queensland Ports Corporation and designating Far North Queensland Ports Corporation Limited is effective from its publication in the Gazette and remains in force until revoked in writing and upon subsequent publication in the Gazette.
