Notice of designation of Port operator – EZion Offshore Logistics Hub (Tiwi) Pty Ltd

 

I, JOHN DAVID RAPHAEL MOODY, Regional Director, Transport Security Operations, Office of Transport Security, under subsection 14(1) of the Maritime Transport and Offshore Facilities Security Act 2003 (the Act):

 

REVOKE the designation of Port Melville Port Authority as the port operator for the security regulated port of Port of Melville as published in the Gazette (No. S 97, 15 June 2006); and

 

DESIGNATE Ezion Offshore Logistics Hub (Tiwi) Pty Ltd to be the port operator for the security regulated port of Port Melville.

 

This Notice commences upon publication in the Gazette.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) provides a framework for ensuring the security of maritime transport and offshore facilities within Australia. Section 14(1) of the Act allows the Regional Director, Transport Security Operations, to designate a port operator for a security regulated port. This legislative instrument revokes the designation of Port Melville Port Authority as the port operator for the Port of Melville, effective from the date of publication in the Gazette (No. S 97, 15 June 2006), and designates Ezion Offshore Logistics Hub (Tiwi) Pty Ltd as the new port operator for the same port. This change is effective immediately upon the publication of the Notice in the Gazette. The Act imposes certain obligations on the designated port operator. As per the provisions of Section 14, the designated port operator, Ezion Offshore Logistics Hub (Tiwi) Pty Ltd, must ensure that the port facilities comply with the security measures outlined in the Act. This includes implementing security plans, maintaining records, and reporting any security-related incidents to the relevant authorities. Additionally, the port operator must cooperate with the Transport Security Operations to facilitate the enforcement of the Act. Breaches of the Act's provisions can lead to significant consequences. Under Section 26, any person who contravenes the Act may be subject to both civil and criminal penalties. For example, an individual or corporation failing to comply with the security measures could face fines up to $22,200 for each offence, as outlined in Section 28. Furthermore, officers of a corporation who are responsible for the breach may also be held personally liable and face fines of up to $11,100. In severe cases, criminal offences may lead to imprisonment, with penalties specified in Section 29. The severity of penalties reflects the importance of maintaining stringent security measures at designated ports to protect national maritime interests.
