Under section 24 of the Act, a person who contravenes a provision of the Act is liable to a penalty. The maximum penalty for an individual is 500 penalty units, which is currently equivalent to approximately AUD 55,000, or for a body corporate, a penalty of up to 2,500 penalty units, currently approximately AUD 275,000. In more severe cases, an individual may also be subject to imprisonment for up to five years, and a body corporate may face imprisonment for up to ten years. These penalties underscore the importance of adhering to the security requirements set out in the Act to ensure the safety and security of maritime transport and offshore facilities in Australia.
