Overview

The Maritime Transport and Offshore Facilities Security Act 2003, enacted by the Australian Parliament, was introduced to address security concerns in maritime transport and offshore facilities. This Act aims to ensure that appropriate security measures are implemented and maintained at designated security regulated ports and offshore facilities to protect against acts of terrorism and other security threats. The legislation empowers the relevant authorities to designate port operators and manage security arrangements to safeguard national interests. In this particular instance, the Notice of Designation issued by Steven Rowson, Regional Director, Transport Security Operations Perth, under subsection 14(1) of the Act, revokes the previous designation of the Department for Planning and Infrastructure (Western Australia) as the port operator for the security regulated port of Barrow Island and designates Chevron Australia Pty Ltd in its place. This change was gazetted on June 5, 2013, and took effect upon publication, underscoring the Act's policy objective of ensuring that designated port operators are equipped to handle security responsibilities effectively.

Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 applies to security-regulated ports within the Commonwealth of Australia, focusing on entities and individuals involved in maritime transport and offshore facilities. This Act mandates the designation of a port operator responsible for ensuring the security of operations within a designated port. In this specific case, the Act revokes the previous designation of the Department for Planning and Infrastructure (Western Australia) as the port operator for the security-regulated port of Barrow Island and designates Chevron Australia Pty Ltd in its place. This change is effective immediately upon the publication of the notice in the Gazette, and it applies solely to the Barrow Island port. The Act's application is further extended or restricted by subordinate instruments as necessary, ensuring that the security measures are tailored to the specific needs and risks of each port. There are no stated exclusions or thresholds within the scope of this particular notice, but the overarching Act may contain provisions addressing broader exemptions or thresholds relevant to different contexts.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) has been amended by this Notice (C2013G01234) to revoke the designation of the Department for Planning and Infrastructure (Western Australia) as the port operator for the security regulated port of Barrow Island (section 14(1)). Instead, Chevron Australia Pty Ltd is now designated as the port operator for the same port. This change was made by Steven Rowson, Regional Director, Transport Security Operations Perth, Office of Transport Security, and is effective as of the publication date in the Gazette, 5 June 2003. This Notice will remain in force until it is revoked in writing and subsequently published in the Gazette. The Act imposes several obligations and requirements on the designated port operator, Chevron Australia Pty Ltd. As the port operator, Chevron Australia Pty Ltd must ensure that all activities within the port comply with the security provisions outlined in the Act. This includes implementing security measures to protect the port and its facilities from potential threats, conducting regular security assessments, and maintaining a security plan that is reviewed and updated as necessary. The port operator must also coordinate with other relevant authorities and agencies to ensure that the port's security measures align with broader maritime security strategies. Breaches of the obligations set out in the Act can lead to various consequences. If Chevron Australia Pty Ltd fails to comply with the security requirements, it may face enforcement actions by the Office of Transport Security or other relevant authorities. The Act does not explicitly state civil or criminal penalties for non-compliance, but the seriousness of maritime security breaches could result in significant regulatory scrutiny, fines, or even criminal charges depending on the circumstances and severity of the breach. The potential penalties could be substantial, reflecting the critical nature of port security in protecting national interests and maritime safety. The revocation and designation process under the Act is straightforward. The Notice revoking the previous designation and assigning a new port operator must be published in the Gazette, as per the statutory requirements. This ensures that all stakeholders are informed of the change in port operator designation. The Notice remains in effect until it is formally revoked and republished in the Gazette, providing a clear and transparent framework for managing port operator changes within the security regulated ports.
