Overview

The Maritime Transport and Offshore Facilities Security Act 2003 was enacted to address the need for enhanced security measures at maritime transport and offshore facilities, mitigating the risks posed by potential terrorist activities or other security threats. This Act was introduced by the Australian Parliament, aiming to protect critical infrastructure and ensure the safety of maritime transport operations within Australian waters. It provides a legislative framework for the declaration and management of security regulated ports, ensuring that stringent security protocols are implemented and enforced. The policy objective of this Act is to safeguard Australia's maritime industry by establishing clear guidelines and responsibilities for maintaining security at designated ports and offshore facilities.

Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 applies to the specified area of the Port of Townsville, which has been declared as a security regulated port under the Act. This area encompasses both land and water, and is defined by specific geographic coordinates that outline its boundaries. The declaration impacts any person or entity conducting activities related to the movement, loading, unloading, maintenance, or provisioning of security regulated ships within this designated area. The Act operates under Commonwealth jurisdiction, and its provisions are enforced to ensure the security of maritime transport and offshore facilities. There are no stated exclusions, exemptions, or thresholds in the Act as it pertains to this declaration. However, the scope and enforcement of the Act may be extended or refined through subordinate instruments such as regulations or orders, which are made under the authority of the Act and further specify the requirements and procedures for maintaining security within the regulated port area.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) contains several key provisions related to the regulation of security in Australian ports. Section 13 of the Act allows for the declaration and revocation of security regulated ports. In this instance, the declaration of the Port of Townsville as a security regulated port was revoked under subsection 13(1) and subsequently re-declared with specific boundaries outlined in the attached map and descriptions. This re-declaration includes areas of land and water used for the movement, loading, unloading, maintenance, or provisioning of security regulated ships. The boundaries of the re-declared security regulated port are meticulously detailed, delineating the specific coordinates and distances that define the port area. Entities and parties governed by the Act must adhere to specific obligations and requirements to ensure compliance with maritime security regulations. These obligations include implementing security measures as outlined in the Act, conducting security assessments, and maintaining records of security measures. Additionally, relevant authorities must ensure that the designated areas are effectively monitored and controlled to prevent unauthorized access and potential security breaches. The re-declaration of the Port of Townsville as a security regulated port underscores the importance of these obligations in maintaining the security of maritime operations. Breach of the provisions outlined in the Maritime Transport and Offshore Facilities Security Act 2003 can result in severe consequences. The Act stipulates that any person who contravenes the provisions may be liable for penalties. Specifically, for corporations, the maximum penalty is 500 penalty units, while for individuals, the penalty is 50 penalty units. These penalties are intended to enforce compliance and deter any actions that could compromise the security of Australian ports. The seriousness of these penalties reflects the critical nature of maritime security and the need for stringent enforcement to protect national interests and ensure the safety of maritime operations.
