Overview

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) was enacted to address the need for enhanced security measures in Australian maritime transport and offshore facilities, aiming to protect against potential terrorist threats and other security risks. The Act was passed by the Parliament of Australia and provides the legal framework for the designation of security regulated ports, among other provisions. The policy objective of the Act is to ensure the security of maritime transport and offshore facilities through the implementation of necessary security measures. Recently, a Notice was issued under subsection 13(1) of the Act, revoking the previous declaration of the security regulated port of Corner Inlet and Port Albert, published in the Gazette on 11 June 2004. The Notice, signed by Colin Sievers, Acting Regional Director, Transport Security Operations, declares that the area of the port of Corner Inlet and Port Albert intended for use in connection with the movement, loading, unloading, maintenance or provisioning of security regulated ships is now a security regulated port. This Notice comes into effect upon its publication in the Gazette on 21 November 2014.

Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 applies to the specified geographic area of the Port of Corner Inlet and Port Albert, which is now declared as a security regulated port. This Act is a Commonwealth legislation, thereby having a jurisdictional reach across the nation. The Act applies to entities involved in maritime transport and offshore facilities, including ships, offshore installations, and port facilities. It regulates the security measures and protocols that need to be adhered to within these areas to ensure the safety and security of the movement, loading, unloading, maintenance, or provisioning of security regulated ships. The declaration of this port as a security regulated port means that stringent security measures and compliance with the Act’s provisions are mandatory for all activities within the specified boundaries. This Notice of declaration comes into effect upon its publication in the Gazette and will remain in force until revoked in writing and subsequently published in the Gazette. The Act does not specify any exclusions or exemptions within the declared security regulated port area, thereby necessitating full compliance from all entities operating within these boundaries.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003 (the Act) governs the security of maritime transport and offshore facilities in Australia. Under section 13 of the Act, the Acting Regional Director, Transport Security Operations, has the authority to revoke or declare a port as a security regulated port. The notice published in the Gazette on 21 November 2014 revokes the previous declaration of the security regulated port of Corner Inlet and Port Albert and declares a new area as a security regulated port. This area includes specific boundaries defined by longitude and latitude coordinates, as well as specific navigational buoys and channel markers. The obligations imposed by the Act on the parties or entities governed by it include adherence to the security measures and protocols established for the security regulated port. This may involve implementing security plans, conducting risk assessments, and complying with specific security requirements for ships and facilities within the port. The Act also requires the port authorities and relevant stakeholders to cooperate and coordinate their efforts to ensure the security of the port and its activities. Failure to comply with the provisions of the Act may result in criminal and civil penalties. The Act provides for various offences, including unauthorised entry into a security regulated port, contravening a security direction, and failing to comply with security requirements. The penalties for these offences can vary depending on the severity of the breach and may include fines, imprisonment, or both. The maximum penalties for certain offences are specified in the Act, with the most serious offences carrying penalties of up to 10 years imprisonment and substantial fines. It is important for individuals and entities operating within the security regulated port of Corner Inlet and Port Albert to familiarise themselves with the provisions of the Act and ensure compliance with the security measures and obligations outlined. Non-compliance can lead to legal consequences and may compromise the security and safety of the port and its activities. Legal advice should be sought to ensure proper understanding and adherence to the requirements of the Act.
