Notice of Declaration of Security Regulated Port – Port of Cairns

I, ROGER VAUGHAN LONIE, Acting Regional Director, Transport Security Operations, Office of Transport Security, under subsection 13(1) of the Maritime Transport and Offshore Facilities Security Act 2003 (the Act):

REVOKE the declaration of the security regulated port of ‘Cairns Port (inner)’ and ‘Cairns Port (outer)’ published in the Gazette (No. GN 22, 2 June 2004) on Line no. 27 and 28 of Column A (the port) and shown on the maps identified as ‘27. Cairns Port (inner)’ on page 1455 and ‘28. Cairns Port (outer)’ on page 1456; and

DECLARE that the area of the port of Port of Cairns intended for use either wholly or partly in connection with the movement, loading, unloading, maintenance or provisioning of security regulated ships, the boundaries of which are shown on the attached map and descriptions, to be a security regulated port.

This Notice commences upon publication in the Gazette.

Description of Port of Cairns

State: Queensland

The Security Regulated Port of Cairns is all of that area of land and water contained within and bounded by a line commencing at a point in the Coral Sea at latitude 16º 47’ 17.18”south, longitude 145º 50’ 18.83” east (point 1);

Thence initially east-south-east but generally south-easterly along geodesics sequentially connecting points closest to coordinates;

Thence south-westerly to Channel Marker (C2) on the south-eastern side of the marked channel leading into Cairns Harbour closest to latitude 16° 50' 00.58” south, longitude 145° 49' 53.71” east, (point6);

Thence generally south-westerly connecting channel markers on the south-eastern side of the channel closest to coordinates;

Thence east-south-easterly to the high water mark on the eastern side of Trinity Inlet in the State of Queensland closest to latitude 16° 55' 31.17” south, longitude 145° 47' 08.19” east (point18);

Thence generally southerly along that high water mark for a distance of approximately 1.7 kilometres to a point a point closest to latitude 16° 56' 25.43” south, longitude 145° 47' 04.78” east, (point 19);

Thence generally south-westerly across Trinity Inlet connecting channel markers closest to coordinates:

Thence initially north-westerly but generally south-westerly for a distance of approximately 1.9 kilometres along that high water mark being the southern bank of Smiths Creek to a point closest to latitude 16° 57' 22.81” south, longitude 145° 46' 23.39” east (point 23);

Thence west-north-west across Smiths Creek to a point on the high water mark of the northern bank of Smiths Creek closest to latitude 16° 57' 22.09” south, longitude 145° 46' 18.42” east (point 24);

Thence generally north-north-east along that high water mark for a distance of approximately 2.6 kilometres to a point at the mouth of a stormwater channel closest to latitude 16° 56' 29.82” south, longitude 145° 46' 30.95” east (point 25);

Thence north-easterly across that channel to a point on the high water mark of Smiths Creek on the western edge of the Fearnley Street public boat ramp closest to latitude 16° 56' 29.30” south, longitude 145° 46' 31.54” east (point 26);

Thence northerly along temporary fencing for a distance of approximately 80 metres

to the north-west corner of wharf 1 closest to latitude 16° 55' 28.69” south, longitude

Thence easterly along the northern face of that wharf face to its intersection east face

of the wharf closest to latitude 16° 55' 28.86” south, longitude 145° 46' 50.98” east

Thence initially northerly but generally north-easterly connecting points within

Trinity Inlet and Cairns Harbour closest to coordinates:

Thence north-north-easterly to the point of commencement.

Notes:

1. The ‘high water mark’ referred to in the Port Description and associated maps means the line of

    ‘mean high water springs’.

2. Unless otherwise stated, all coordinates are in WGS 84 geodetic datum.

3. In the event that a point of latitude and longitude which is stated to lie on the high water mark is

    found to lie on the landward or seaward side of the high water mark the point is to be regarded as

    being the point on the high water mark closest to that point of latitude and longitude.

4. Unless stated otherwise, the Security Regulated Port described above includes all water and land

    inside the area and excludes all private or recreational wharves, jetties and marinas.

5. Unless otherwise stated the landside boundaries are fenced.

6. Unless otherwise stated the lines between coordinates are rhumb lines (loxodromes).

7. This description should be read in conjunction with the Security Regulated Port Boundary map. In

    the event of an inconsistency between the written description and the map, the former prevails.
