Notice of Declaration of Security Regulated Port – Port of Bunbury

Maritime Transport and Offshore Facilities Security Act 2003

I, STEVEN ROWSON, Regional Director, Transport Security Operations, Office of Transport Security, under subsection 13(1) of the Maritime Transport and Offshore Facilities Security Act 2003 (the Act):

REVOKE the declaration of the security regulated port of Port of Bunbury published in the Gazette (No. GN/S 189, 04 June 2004) on Line no. 11 of Column A (the port) and shown on the map identified as Port of Bunbury on page 11; and

DECLARE that the area of the port of Port of Bunbury intended for use either wholly or partly in connection with the movement, loading, unloading, maintenance or provisioning of security regulated ships, the boundaries of which are shown on the attached map and descriptions, to be a security regulated port.

This Notice commences upon publication in the Gazette.

SECURITY REGULATED PORT BOUNDARY DESCRIPTION

Description of the Security Regulated Port of Bunbury State: Western Australia

The Security Regulation Port of Bunbury is all of that area of land and water contained within and bounded by a line commencing at a point on the high water mark of the coastline of Western Australia at latitude 33° 19' 07.41" south, longitude 115° 37' 54.97" east (point 1);

• Thence north-westerly along a geodesic line to a point in the Indian Ocean at latitude 33º 17’ 19.66” south, longitude 115º 35’ 22.81” east (point 2);

• Thence north-easterly along a geodesic line to a point in the Indian Ocean at latitude 33º 15’ 25.66” south, longitude 115º 36’ 53.41” east (point 3);

• Thence east along that parallel of latitude to its intersection with the high water mark of the coastline of Western Australia on Leschenault Peninsula closest to longitude 115º 40’ 53.63” east (point 4);
• Thence generally southerly along the high water mark of that coastline for a distance of approximately 5.4 kilometres to a point on the western end of the north breakwater of the Leschenault Estuary known as The Cut closest to latitude 33° 18' 09.97" south, longitude 115° 40' 12.88" east (point 5);

• Thence southerly across that Estuary to a point on the high water mark at the western end of the southern breakwater closest to latitude 33° 18' 13.42" south, longitude 115° 40' 10.89" east (point 6);

• Thence initially south-easterly but generally south-westerly along that high water mark for a total distance of approximately 2.2 kilometres sequentially connecting points at coordinates:

• Thence south-easterly along an unmarked geodesic line for a distance of approximately 50 metres to a point on a security fence south of the former power station closest to latitude 33° 19' 00.21" south, longitude 115° 39' 40.13" east (point 12);

• Thence initially northerly but generally north-north-easterly along that security fence for a total distance of approximately 400 metres sequentially connecting points at coordinates:

• Thence north-easterly along the face of a concrete wall for a distance of approximately 65 metres unit it intersects with a security fence closest to latitude 33° 18' 49.48" south, longitude 115° 39' 45.50" east (point 17);
• Thence generally north easterly along that security fence for a total distance of approximately 1.1 kilometres sequentially connecting points at coordinates:

• Thence south-easterly across Leschenault Drive for a distance of approximately 8 metres to the eastern edge of the road closest to latitude 33° 18' 34.19" south, longitude 115° 40' 18.14" east (point 22);

• Thence generally south-westerly along that bitumen edge of Leschenault Drive for a total distance of approximately 400 metres sequentially connecting point at coordinates:

• Thence continuing generally south-easterly along that edge of a bitumen road for a total distance of approximately 1.4 kilometres to its intersection with Leschenault Drive sequentially connecting points at coordinates:

• Thence continuing south-easterly along the north-eastern edge of Leschenault Drive to its intersection with a level crossing the rail access to wharves 6 & 8 closest to latitude 33° 19' 17.07" south, longitude 115° 40' 35.17" east (point 31);

• Thence south-south-westerly across that level crossing on the south-eastern side of Leschenault Drive and continuing along the south-eastern edge of Leschenault Drive for a total distance of approximately 1.3 Kilometres sequentially connecting points along that road edge at coordinates:

• Thence south-easterly along the south-east edge of the bitumen road, being the main access road to Bunbury Inner Harbour wharves and abutting to the west of Colin Ganfield Park, for a distance of approximately 80 metres to its intersection with the main security gate closest to latitude 33° 19' 50.37" south, longitude 115° 40' 02.79" east (point 37);

• Thence westerly across that security gate for a distance of approximately 20 metres to its intersection with the edge of the bitumen on the south-western side closest to latitude 33° 19' 50.55" south, longitude 115° 40' 02.12" east (point 38);

• Thence generally north-north-westerly for a distance of approximately 145 metres along the alignment of the western side of the bitumen of the Inner Harbour access road to a point on that alignment and on the northern side of a railway line closest to latitude 33° 19' 46.01" south, longitude 115° 40' 00.49" east (point 39);

• Thence south-easterly along an unmarked line for a distance of approximately 17 metres to a corner in the security fence on the northern side of a railway line closest to latitude 33° 19' 46.27" south, longitude 115° 39' 59.89" east (point 40);

• Thence initially south-westerly but generally westerly for a total distance of approximately 425 metres along that security fence on the northern and north-eastern side of the railway line sequentially connecting points at coordinates:

• Thence south-westerly for a distance of approximately 5 metres across a security gate on the railway line to a point on the security fence closest to latitude 33° 19' 43.59" south, longitude 115° 39' 45.43" east (point 45);

• Thence generally north-westerly along that security fence running parallel to a railway line to the west for a total distance of approximately 800 metres sequentially connecting points at coordinates:

• Thence initially south-westerly across a branch of the railway line and then continuing north-westerly along the security fence for a total distance of approximately 65 metres sequentially connecting points at coordinates:

• Thence initially north-easterly along a security gate across a railway line and then continuing along that security fence for a total distance of approximately 275 metres sequentially connecting points at coordinates:

• Thence north-westerly along an unmarked line for a distance of approximately 13metres to the corner of a security fence closest to latitude 33° 19' 20.27" south, longitude 115° 39' 12.14" east (point 53);

• Thence generally north-westerly along that security fence for a total distance of approximately 200 metres sequentially connecting points at coordinates:

• Thence northerly for a distance of approximately 15 metres across a security gate to a corner in a security fence closest to latitude 33° 19' 15.32" south, longitude 115° 39' 07.12" east (point 56);

• Thence initially south-south-easterly but generally north-north-easterly along that security fence for a total distance of approximately 80 metres sequentially connecting points at coordinates:

• Thence northerly for a distance of approximately 60 metres along an unmarked line to a point on the high water mark of the coast of Western Australian in Koombana Bay closest to latitude 33° 19' 11.26" south, longitude 115° 39' 07.72" east (point 59);

• Thence north-north-west along a geodesic line across Koombana Bay to the north-east corner of a disused timber jetty closest to latitude 33° 18' 26.73" south, longitude 115° 38' 45.86" east (point 60);
• Thence initially north-westerly but generally south-westerly along the north-east and south-western faces of that disused timber jetty sequentially connecting points at coordinates:

• Thence south-south-westerly along the western edge of that wharf to its intersection with the high water mark on a rock breakwater closest to latitude 33° 18' 40.48" south, longitude 115° 38' 33.78" east (point 63);

• Thence initially south-westerly but generally north-westerly along that high water mark for a distance of approximately 95 metres to a point on the western extremity of the breakwater closest to latitude 33° 18' 38.68" south, longitude 115° 38' 31.83" east (point 64);

• Thence west-north-westerly along a geodesic line for a distance of approximately 155 metres across the entrance of Casuarina Boat Harbour to a point on the high water mark of the coastline of Western Australia closest to latitude 33° 18' 36.17" south, longitude 115° 38' 26.66" east (point 65);

• Thence generally north-north-east along that high water mark for a distance of approximately 50 metres to its intersection with a security fence on the southern edge of a service jetty closest to latitude 33° 18' 34.62" south, longitude 115° 38' 27.44" east (point 66);
• Thence initially west-north-westerly but generally westerly along that security fence for a distance of approximately 95 metres to its intersection with a steel silo closest to latitude 33° 18' 34.63" south, longitude 115° 38' 23.87" east (point 67);

• Thence south-easterly and then south westerly along the external walls of that silo to a point on the south-western corner of that silo closest to latitude 33° 18' 35.07" south, longitude 115° 38' 22.19" east (point 68);

• Thence south-south-westerly along a security fence for approximately 15 metres to the north-western corner of a steel shed closest to latitude 33° 18' 35.54" south, longitude 115° 38' 21.86" east (point 69);

• Thence south-south-westerly along the western face of that shed to the south-western corner of that shed closest to latitude 33° 18' 35.87" south, longitude 115° 38' 21.67" east (point 70);

• Thence west-north-westerly along a security fence for a distance of approximately 10 metres to its intersection with the south-eastern face of a steel and concrete silo closest to latitude 33° 18' 35.74" south, longitude 115° 38' 21.34" east (point 71);

• Thence initially south-south-westerly but generally westerly along the south-east, south-western and north-western external walls of that silo to a point of intersection with a security fence closest to latitude 33° 18' 34.77" south, longitude 115° 38' 18.74" east (point 72);

• Thence north-westerly along that security fence for a distance of approximately 35 metres to a security gate across Casuarina Drive closest to latitude 33° 18' 33.90" south, longitude 115° 38' 17.82" east (point 73);

• Thence initially north-westerly across that security gate and then south-east along a security fence for a total distance of approximately 20 metres sequentially connecting points at coordinates:

• Thence north-westerly for a distance of approximately 30 metres along that security fence to its intersection with the high water mark of Western Australia along the outer edge of the rock sea wall closest to latitude 33° 18' 33.43" south, longitude 115° 38' 16.43" east (point 76);

• Thence initially south-westerly but generally westerly along that high water mark for a total distance of approximately 300 metres sequentially connecting point at coordinates:

• Thence continuing generally south-south-westerly along that high water mark for a distance of approximately 1.2 kilometres to the point of commencement.

Notes:

1. The ‘high water mark’ referred to in the Port Description and associated maps means the line of ‘mean high water springs’.

2. Unless otherwise stated, all coordinates are in WGS 84 geodetic datum.

3. In the event that a point of latitude and longitude which is stated to lie on the high water mark is found to lie on the landward or seaward side of the high water mark the point is to be regarded as being the point on the high water mark closest to that point of latitude and longitude.

4. Unless stated otherwise, the Security Regulated Port described above includes all water and land inside the area and excludes all private or recreational wharves, jetties and marinas.

5. Unless otherwise stated the landside boundaries are fenced.

6. Unless otherwise stated the lines between coordinates are rhumb lines (loxodromes).

7. This description should be read in conjunction with the Security Regulated Port Boundary map. In the event of an inconsistency between the written description and the map, the former prevails.
