Notice of declaration of security regulated OFFSHORE FACILITY north rankin COMPLEX

 

 

I, STEVEN ROWSON, Regional Director, Transport Security Operations, Office of Transport Security, under subsection 17B(1) of the Maritime Transport and Offshore Facilities Security Act 2003 (the Act):

 

REVOKE the declaration of North Rankin Alpha as a security regulated offshore facility as published in the Gazette (No. S162, 21 September 2005), listed in Column A (offshore oil and gas facility) and shown on the map identified as North Rankin Alpha’ on page 55; and

 

DECLARE the North Rankin Complex (comprising of North Rankin A and North Rankin B offshore facilities) which is located in an offshore area and used in the extraction of petroleum from the seabed or its subsoil with equipment on, or forming part of the facility, the location and boundaries of which are shown on the attached map, to be a security regulated offshore facility.

 

This Notice commences upon publication in the Gazette.

Overview

The Maritime Transport and Offshore Facilities Security Act 2003 was enacted to address the problem of ensuring the security of maritime transport and offshore facilities against acts of terrorism and other security threats. This Act was introduced by the Parliament of Australia, aiming to protect critical infrastructure and ensure the safety of personnel operating in these environments. The policy objective of the Act is to establish a framework for the regulation of security measures for offshore facilities, thereby contributing to the national security and economic stability of Australia by safeguarding its offshore energy resources. This legislative framework empowers the relevant authorities to enforce stringent security protocols and to declare specific offshore facilities as security regulated, as seen in the revocation and declaration of the North Rankin Complex detailed in the Gazette Notice of 2012.

Scope and Application

The Maritime Transport and Offshore Facilities Security Act 2003 applies to offshore facilities involved in the extraction of petroleum from the seabed or its subsoil, as well as related maritime transport activities. The Act imposes security obligations on the persons and entities responsible for these facilities to ensure their protection against security threats. The geographic reach of the Act is national, applying across the Commonwealth of Australia, including its territorial waters and the continental shelf. The Act's application extends to both existing and future offshore facilities, making it a comprehensive regulatory framework for the security of offshore petroleum operations. The revocation of the North Rankin Alpha facility's declaration as a security-regulated offshore facility and the subsequent declaration of the North Rankin Complex as such exemplifies the Act's adaptability through subordinate instruments, enabling the regulation to be fine-tuned in response to operational changes or security assessments.

Key Provisions

The Maritime Transport and Offshore Facilities Security Act 2003, specifically under section 17B(1), outlines the authority of the Regional Director, Transport Security Operations, to manage the declaration of offshore facilities as security regulated. In this instance, the Regional Director has revoked the previous declaration of North Rankin Alpha as a security regulated offshore facility (section 17B(1)(a)) and has declared the North Rankin Complex, which includes North Rankin A and North Rankin B, to be a security regulated offshore facility (section 17B(1)(b)). This complex is used for the extraction of petroleum from the seabed or its subsoil and is situated in an offshore area. The location and boundaries of the complex are depicted on an attached map. The Act imposes several obligations and requirements on the parties or entities governed by it. For the North Rankin Complex, these obligations include ensuring that appropriate security measures are in place to protect the facility from security threats. This involves compliance with any security plans approved by the Regional Director and the implementation of any additional measures deemed necessary by the Regional Director. The Act also mandates that the facility maintain records of security-related activities and make these records available for inspection by authorised officers (section 17A). Failure to comply with the provisions of the Act can result in both civil and criminal consequences. The Act provides for offences related to non-compliance with security requirements, with penalties including fines and imprisonment. For instance, under section 17D, a person who fails to comply with a requirement under the Act can be subject to a fine of up to 500 penalty units or imprisonment for up to five years, or both. Additionally, the Act allows for the imposition of administrative penalties, including fines of up to 10,000 penalty units, as outlined in section 17E. These penalties serve as deterrents to non-compliance and ensure that security measures are effectively implemented and maintained.
