Key Provisions

The Aviation Transport Security Act 2004 (the Act) is subject to modifications regarding the designation of security controlled airports and the establishment of airside areas. In the notice NTC-15922, the Director, Transport Security Operations, Aviation and Maritime Security Division, Stephen John Weber, revokes the previous declaration of Mildura Airport as a security controlled airport, which was originally declared in Notice NTC-8157 published in the Gazette on 26 June 2015 (C2015G01010). Under section 28(2) of the Act, this revocation takes effect upon publication of the new notice in the Gazette. Furthermore, the notice declares Mildura Airport as a security controlled airport and establishes the boundaries of the airport, which are detailed in the accompanying map forming part of the notice. Additionally, section 29 of the Act is invoked to establish an airside area for Mildura Airport, as indicated on the attached maps. Entities and parties governed by the Act, particularly those operating within the declared security controlled airport and airside area at Mildura Airport, are subject to certain obligations and requirements. These include compliance with all security regulations and measures as stipulated by the Act. Operators within the airside area must ensure that all personnel and materials entering this area adhere to stringent security protocols. This might include background checks, screening procedures, and adherence to restricted access controls. Furthermore, these entities must collaborate with the Department of Home Affairs to implement and maintain the required security measures and respond to any security incidents that may arise. The Act delineates various offences and penalties for breaches of its provisions. Section 313 of the Act imposes a criminal offence for non-compliance with security measures, which may include entering a security controlled airport or airside area without authorisation. The maximum penalty for this offence is imprisonment for five years or a fine of up to 5,000 penalty units, or both. Additionally, section 314 imposes penalties for obstructing or interfering with authorised officers carrying out their duties under the Act. The penalty for such offences is imprisonment for two years or a fine of up to 2,000 penalty units, or both.
