NOTICE OF DECLARATION OF SECURITY CONTROLLED AIRPORT AND AIRSIDE AREA – Kingscote / Kangaroo Island Aerodrome
I, Jacqueline Ireland, Director, Transport Security Operations, Office of Transport Security:
REVOKE, under subsection 28(2) of the Aviation Transport Security Act 2004 (the Act),
Notice NTC-2313 which declared Kingscote / Kangaroo Island Aerodrome as a security
controlled airport as published in the Gazette (C2014G01346, 15 August 2014);
DECLARE, under subsection 28(2) of the Act, that Kingscote / Kangaroo Island Aerodrome
is a security controlled airport, the boundaries of Kingscote / Kangaroo Island Aerodrome are shown on the attached map which forms part of this notice; and
ESTABLISH, in accordance with section 29 of the Act, an airside area for Kingscote /
Kangaroo Island Aerodrome being that area indicated as the airside area on the attached map.
This Notice commences upon publication in the Gazette.

Overview

In 2017, a notice was published in the Gazette revoking a previous declaration that had designated Kingscote/Kangaroo Island Aerodrome as a security controlled airport. This revocation was followed by a new declaration, under the authority of the Act, to re-establish the airport as a security controlled location, along with the establishment of an airside area as defined in the attached map. This change in status and boundary delineation is aimed at maintaining robust security protocols in accordance with the overarching objectives of the Act.

The Aviation Transport Security Act 2004 applies to various entities and persons involved in aviation transport, including airlines, airports, and individuals operating within the defined security controlled airports and airside areas. The Act mandates stringent security measures to protect the integrity of aviation transport in Australia. Specifically, this Act extends its jurisdiction to any person or entity involved in activities within the designated security controlled airports and airside areas, such as Kingscote / Kangaroo Island Aerodrome, as declared under the Act. The geographic reach of the Act is national, applying uniformly across all states and territories within the Commonwealth of Australia. While the Act provides comprehensive coverage, it allows for certain exclusions and exemptions, typically outlined in subordinate instruments or specific regulations that further define operational parameters and compliance requirements. This Notice, revoking the previous security control declaration for Kingscote / Kangaroo Island Aerodrome and establishing new boundaries and an airside area, is an example of how the Act’s application can be adjusted through specific legislative instruments.

For example, section 35A imposes a maximum penalty of 10,000 penalty units or imprisonment for two years, or both, for contravening a security direction. Similarly, section 35B sets out a maximum penalty of 5,000 penalty units or imprisonment for one year, or both, for failing to comply with a security requirement. These provisions underscore the seriousness with which the Act treats non-compliance, aiming to deter breaches through substantial penalties and reinforce the importance of adhering to aviation security measures.
