Overview
The Aviation Transport Security Act 2004 (the Act) was enacted to address the need for stringent security measures to protect Australia's aviation infrastructure and passengers from terrorist threats and other security risks. This legislation was introduced by the Commonwealth Parliament to establish a comprehensive framework for aviation security, ensuring the safety and security of air travel across the nation. The policy objective of the Act is to prevent and mitigate threats to civil aviation, thereby safeguarding public safety and maintaining the integrity of the aviation transport system.
In the context of the Karratha Airport, the Act empowers the Department of Infrastructure and Regional Development to designate specific areas within the airport as security controlled and to establish designated airside areas. The 2015 Notice of Declaration of Security Controlled Airport and Airside Area for Karratha Airport, issued by Anastasia Du Toit, Acting Director of Transport Security Operations, revokes a previous declaration and reaffirms the security status of Karratha Airport, outlining its boundaries and designated airside area. This action underscores the ongoing commitment to enforce robust security protocols at designated airports to protect against potential threats.
Scope and Application
The Aviation Transport Security Act 2004, as evidenced by this Notice of Declaration of Security Controlled Airport and Airside Area for Karratha Airport, applies to the specific geographic and operational scope of Karratha Airport, identifying it as a security controlled airport and establishing its airside area. This Act applies to any person or entity conducting activities within the designated boundaries of Karratha Airport, as well as any aviation-related conduct or transactions occurring within the established airside area. The application of the Act extends across the Commonwealth of Australia, with its provisions being applicable nationally. There are no stated exclusions or exemptions within the notice itself, although the Act may provide for such provisions in its broader legislative framework. The Act's scope and specific application to Karratha Airport can be further detailed or modified through subordinate instruments, ensuring adaptability and precision in aviation security management. This Notice, effective from its publication in the Gazette, supersedes any previous declarations and remains in effect until formally revoked and re-published in the Gazette.
Key Provisions
The Notice of Declaration of Security Controlled Airport and Airside Area – Karratha Airport, issued under subsection 28(2) of the Aviation Transport Security Act 2004 (the Act), revokes the previous declaration that designated Karratha Airport as a security controlled airport, which was published in the Gazette on 6 March 2009 (Notice s28/2009008). This revocation is accompanied by a new declaration under subsection 28(2) of the Act, which now officially recognises Karratha Airport as a security controlled airport. The boundaries of the airport and its designated airside area are clearly outlined in the attached map, which forms an integral part of this notice. Furthermore, in accordance with section 29 of the Act, an airside area for Karratha Airport is established, with its extents as indicated on the same attached map.
The Act imposes several obligations and requirements on parties and entities governed by this legislation. Firstly, it mandates that Karratha Airport must now adhere to the stringent security measures and protocols specified by the Act. This includes ensuring that all areas within the airport premises, especially the newly defined airside area, are secure and comply with the stringent aviation security standards. This encompasses the implementation of access control measures, surveillance systems, and other security apparatus to safeguard the airport and its operations. Moreover, all personnel, including staff, contractors, and visitors, must undergo necessary security clearances and training to maintain the high standards of security expected at a security controlled airport.
Breaches of the obligations and requirements stipulated in the Act can lead to significant legal consequences. Under the Act, violations may result in both civil and criminal penalties. For instance, individuals or entities failing to comply with the security measures may face fines and imprisonment. The maximum penalties can vary depending on the severity and nature of the breach. For example, offences that result in serious harm or death can attract more severe penalties, reflecting the gravity of the situation. Additionally, the Act provides for other enforcement measures, such as the imposition of administrative penalties or the revocation of operational licenses, which further underscores the importance of strict adherence to the security protocols mandated by the Act.
