Overview

The Aviation Transport Security Act 2004 was enacted by the Parliament of Australia to address the need for stringent security measures within the aviation sector to protect passengers, aircraft, and airport infrastructure from potential threats. This Act was introduced to ensure that aviation security was uniformly managed across the nation, thereby safeguarding the aviation industry and enhancing public confidence in air travel. The policy objective of the Act is to provide a legislative framework that supports the implementation of effective aviation security measures, including the designation of security controlled airports and the establishment of airside areas. The Act empowers the Director, Transport Security Operations, to declare and manage these areas, ensuring that appropriate security controls are in place. This particular notice, issued by Michael Rowe, a delegate of the Secretary of the Department of Infrastructure and Regional Development, pertains to the revocation of a previous declaration regarding Coffs Harbour Airport as a security controlled airport and the re-establishment of the airport under the Act. The notice clarifies the boundaries of the airport and the newly designated airside area, which is critical for enforcing security measures. This action ensures that the airport continues to meet the necessary security standards as outlined by the Act, thereby maintaining the integrity of Australia’s aviation security framework.

Scope and Application

The Aviation Transport Security Act 2004 applies to various persons, entities, and industries involved in the operation and security of airports, aircraft, and aviation transport services within Australia. This includes the establishment of security controlled airports and the delineation of airside areas, as illustrated in the case of Coffs Harbour Regional Airport. The Act operates on a Commonwealth level, thereby ensuring a uniform approach to aviation security across the nation. The scope of the Act encompasses the regulation of conduct and transactions that directly impact aviation security, but it does not explicitly state exclusions, exemptions, or specific thresholds in this particular notice. The application and enforcement of the Act can be extended or restricted through subordinate instruments, which may include regulations and other instruments that provide further detail and operational guidance. The revocation and re-declaration of security controlled airports and airside areas, as seen in the notice concerning Coffs Harbour Regional Airport, are examples of how the Act's provisions can be adjusted to meet changing security needs and operational realities.

Key Provisions

The Aviation Transport Security Act 2004, as amended by the Notice of Declaration of Security Controlled Airport and Airside Area for Coffs Harbour Regional Airport, outlines key provisions that pertain to the security of the airport and its airside area. Under section 28(2) of the Act, the Director of Transport Security Operations has the authority to revoke or declare a security controlled airport. In this instance, Notice A04045, which previously declared Coffs Harbour Airport as a security controlled airport, is revoked, and a new declaration is issued for Coffs Harbour Regional Airport (section 28(2)). Furthermore, section 29 of the Act is invoked to establish the boundaries of the airside area for Coffs Harbour Regional Airport, as detailed on the map annexed to this notice. This Act imposes specific obligations and requirements on various parties and entities. The Director of Transport Security Operations, as the delegate of the Secretary of the Department of Infrastructure and Regional Development, has the responsibility to ensure that the declared security controlled airport and its airside area are appropriately managed and secured. This includes implementing measures to prevent unauthorised access and potential security threats. The boundaries of the airport and its airside area, as defined in the accompanying map, must be respected and maintained to ensure the effective enforcement of aviation security regulations. Breaches of the provisions under the Aviation Transport Security Act 2004 can result in serious consequences. The Act outlines various offences and penalties for non-compliance. For example, unauthorised access to a security controlled airport or airside area can be considered a criminal offence, subject to penalties as stipulated in the Act. The maximum penalties for such offences can include substantial fines and imprisonment terms, reflecting the seriousness of compromising aviation security. Additionally, civil penalties may apply for breaches of the Act, providing further deterrents against non-compliance. The Notice of Declaration of Security Controlled Airport and Airside Area for Coffs Harbour Regional Airport is effective upon publication in the Gazette and remains in force until it is formally revoked and republished in the Gazette. This ensures that there is a clear and legally binding declaration of the security status of the airport and its airside area, which is essential for maintaining national security and public safety in the aviation sector. The legal framework provided by the Act and this notice helps to safeguard against potential threats and ensures that stringent security measures are in place.
