NOTICE OF DECISION TO VARY AN APPROVAL UNDER THE FUEL QUALITY STANDARDS ACT 2000 FOR VP RACING FUELS PTY LTD

I, Chris Videroni, Acting Assistant Secretary, Environment Protection Branch, Department of the Environment, delegate of the Minister for the Environment, provide the following information concerning my decision made pursuant to section 17 of the Fuel Quality Standards Act 2000 to vary an approval granted under section 13 of the Act to add a regulated person to the approval.

On 5 December 2014 an approval was granted to VP Racing Fuels Pty Ltd (the approval). The approval varies the Fuel Standard (Petrol) Determination 2001 to permit the supply of racing fuel as specified in the approval. VP Racing Fuels Pty Ltd has since applied for a variation to the approval to add a regulated person.

Period of operation

The approval, as varied, comes into force on the date of signing and remains in force until 31 December  2016.

Summary of reasons for the approval

I grant the approval as provided for in section 15 of the Act for the following reasons:

  1. The volume of fuel to be supplied under the approval is unlikely to alter significantly by the addition of one regulated person, therefore no significant additional impact on the environment is expected.
  2. The addition of one regulated person to the approval is not expected to pose significant safety concerns.

Overview

In this instance, the approval granted to VP Racing Fuels Pty Ltd has been varied to include Cairns Performance Parts as an additional regulated person, thereby extending the scope of the approval to encompass the new entity. This variation was approved based on the assessment that the additional regulated person would not significantly impact the environmental or safety considerations associated with the supply of racing fuel. The approval is effective until 31 December 2016, and any further variations or extensions would require additional assessment and approval under the Act.

Key Provisions

The exact penalties would depend on the nature and severity of the breach, as well as any relevant state or territory laws that may apply.
