Overview
The Regional Forest Agreement Act 2002 was enacted by the Parliament of Australia to establish a framework for regional forest agreements between the Commonwealth and the states. This Act was introduced to address the need for a sustainable and balanced approach to forest management across various regions in Australia, ensuring that economic, environmental, and social interests are considered. The policy objective of the Act was to facilitate cooperative agreements that promote the sustainable use of forests while preserving biodiversity and supporting local economies. Julie Collins, the Minister for Agriculture, Fisheries and Forestry, issued a notice on 17 February 2025 under subsection 9(2) of the Act, declaring the cessation of several Regional Forest Agreements between the Commonwealth and the State of Victoria, effective from 31 December 2024. These agreements, which had been in place for various regions in Victoria since the late 1990s, included the Central Highlands, East Gippsland, Gippsland, North East, and West Victoria regions, each amended over time to reflect changing circumstances and requirements.
Scope and Application
The notice of cessation pertains to several Regional Forest Agreements between the Commonwealth and the State of Victoria, which ceased to be in force on 31 December 2024. These agreements include the Central Highlands Regional Forest Agreement, East Gippsland Regional Forest Agreement, Gippsland Regional Forest Agreement, North East Regional Forest Agreement, and West Victoria Regional Forest Agreement, all of which were amended over time. The cessation applies to the persons and entities that were parties to these agreements, including government bodies and possibly private entities involved in forestry within the specified regions. The jurisdictional reach of this notice is within the state of Victoria, affecting the forestry practices and governance within its specified regions. There are no stated exclusions or exemptions in the notice; however, the full implications of the cessation may be further detailed in subordinate instruments or subsequent legislation. This cessation will impact the regulatory framework governing forestry activities in the regions covered by the agreements, necessitating compliance with new or revised legislation in 2025.
Key Provisions
The Notice of Cessation of Regional Forest Agreements between the Commonwealth and the State of Victoria, issued under subsection 9(2) of the Regional Forest Agreement Act 2002, details the cessation of several regional forest agreements as of 31 December 2024. These agreements include the Central Highlands Regional Forest Agreement (entered into on 27 March 1998), the East Gippsland Regional Forest Agreement (entered into on 3 February 1997), the Gippsland Regional Forest Agreement (entered into on 31 March 2000), the North East Regional Forest Agreement (entered into on 9 August 1999), and the West Victoria Regional Forest Agreement (entered into on 31 March 2000). Each of these agreements, as amended over time, are no longer in force as of the specified date.
The cessation of these agreements imposes obligations on the parties involved, namely the Commonwealth and the State of Victoria. These obligations include the need to ensure that all activities governed by the agreements are concluded or transitioned in accordance with the terms stipulated in the agreements themselves, as well as any subsequent amendments. The parties must also ensure that any outstanding responsibilities or commitments under the agreements are fulfilled or appropriately managed in the absence of the agreements.
In terms of consequences, breaches of the obligations imposed by the agreements may lead to both civil and criminal penalties. Although the specific penalties are not detailed within the notice, breaches of similar nature under the Regional Forest Agreement Act 2002 can result in significant fines. Civil penalties can be substantial, with maximum fines often aligning with the severity of the breach and the economic impact. Criminal penalties may also apply, particularly in cases of willful or negligent breaches, which could lead to imprisonment. The exact penalties would depend on the specific provisions of the agreements and relevant case law.
