GRAEME ALBERT WATERS
TITLES ADMINISTRATOR
ON BEHALF OF THE COMMONWEALTH-WESTERN AUSTRALIA
OFFSHORE PETROLEUM JOINT AUTHORITY
Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted by the Commonwealth Parliament to establish a framework for the regulation of offshore petroleum exploration, production, and storage, as well as greenhouse gas storage in Australia. This legislation was introduced to address the need for a coordinated and comprehensive regulatory regime to manage the environmental, economic, and social impacts of offshore petroleum activities, ensuring sustainable development and conservation of marine ecosystems. The policy objective of the Act is to provide for the sustainable exploration and production of offshore petroleum resources while protecting the marine environment and ensuring that greenhouse gas storage activities are conducted in a safe and environmentally responsible manner. The Act aims to balance the interests of industry, the environment, and the public, facilitating the development of Australia's offshore petroleum resources in a manner that supports economic growth and energy security.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 is a Commonwealth Act that applies to offshore petroleum activities and greenhouse gas storage within Australian waters, excluding the internal waters of the Ashmore and Cartier Islands. The Act applies to persons and entities involved in exploration, production, and storage activities, including companies such as Arcadia Petroleum Limited and Cathay Petroleum International Limited, as evidenced by their involvement in Petroleum Exploration Permit WA-379-P. The Act regulates these activities to ensure compliance with specified conditions, such as work commitments and seismic survey requirements. The geographic reach of the Act encompasses Australia's territorial sea and the Australian Exclusive Economic Zone (EEZ), extending the application of the Act to offshore areas under Commonwealth jurisdiction. The Act includes provisions for the cancellation of permits like WA-379-P for non-compliance, as demonstrated in the notice of cancellation due to Arcadia Petroleum Limited and Cathay Petroleum International Limited's failure to meet seismic survey commitments. The Act can extend its application through subordinate instruments, which may include regulations and guidelines to further specify operational standards and compliance measures.
Key Provisions
Section 275 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 provides the legal basis for the cancellation of a petroleum exploration permit. In this specific case, the permit in question is Petroleum Exploration Permit WA-379-P, held by Arcadia Petroleum Limited and Cathay Petroleum International Limited. The cancellation notice outlines the grounds for cancellation, which include non-compliance with Condition 1 (Work Commitments) and Condition 5 of the permit, particularly the failure to meet the Permit Year 5 seismic survey commitment.
The obligations under the Act for permit holders like Arcadia Petroleum Limited and Cathay Petroleum International Limited are significant. They must adhere to the work commitments outlined in their permit, which in this case, includes conducting a seismic survey by Permit Year 5. Failure to meet these commitments can result in the permit being cancelled, as evidenced by the notice issued. The Act mandates that permit holders conduct their exploration activities in a manner that complies with all stipulated conditions, ensuring that offshore petroleum exploration is managed responsibly and sustainably.
Breaching the conditions of a petroleum exploration permit can lead to severe consequences. Under Section 275 of the Act, the National Offshore Petroleum Titles Administrator can cancel the permit if the conditions are not met. The notice of cancellation becomes effective on the day it is published in the Australian Government Gazette. Additionally, the Act does not specify maximum penalties for breaches; however, it is clear that the consequences of non-compliance can be significant, including the loss of the exploration permit and potentially other legal or administrative repercussions.
