Overview
The Financial Sector (Shareholdings) Act 1998 was enacted by the Parliament of Australia to address the need for regulatory oversight on significant shareholdings in the financial sector. This Act empowers the Treasurer to approve or disapprove acquisitions of qualifying shareholdings by entities that are not authorised deposit-taking institutions, ensuring that such acquisitions do not undermine financial stability. The legislative framework aims to protect consumers and maintain confidence in the financial system by preventing potential conflicts of interest or undue concentration of market power. The approval granted under this Act, as seen in the notice dated 14 August 2019, reflects the Treasurer's determination that the acquisition of 100 per cent of the gross assets and liabilities of Bananacoast Community Credit Union Limited by Police & Nurses Limited is in the national interest. This decision underscores the importance of maintaining rigorous oversight to safeguard the integrity and resilience of Australia's financial sector.
