NOTICE OF APPLICATION THE REGISTRATION OF AN ASSOCIATION OF EMPLOYEES

NOTICE is given that an application has been made under section 18 of the Fair Work (Registered Organisations) Act 2009 for the registration of an association called The Ambulance Employees Association of Western Australia Incorporated as an organisation of employees.
A copy of the application has been published on the website of the Fair Work Commission at: <http://www.fwc.gov.au> (under “Registered Organisations”, click on “Gazette Notices”).
Alternatively, a copy of the application and any documents relating to it can be obtained by any organisation, association, branch, constituent part or reporting unit (or a member thereof) on request from the Fair Work Commission. Requests should be marked attention to the Registered Organisations Services Branch, Fair Work Commission and emailed to regorgs@fwc.gov.au or posted to GPO Box 1994, Melbourne 3001.
The eligibility rules of the association are:
“PART 1 – GENERAL
5. Industry
The industry in and in connection with which the AEAWA is formed is the industry of ambulance work anywhere in the State of Western Australia, and work that is in connection with or ancillary to such ambulance work.

PART 2 - ELIGIBILITY
9. Eligibility – Industry rule
The AEAWA shall consist of an unlimited number of members who work as employees in or in connection with the ambulance industry anywhere in the State of Western Australia.
10. Eligibility – Occupations rule
The AEAWA shall consist of an unlimited number of members who work as employees in the following occupations anywhere in the State of Western Australia: student ambulance officer, ambulance officer, ambulance paramedic, medic, ambulance driver, communications officer, station manager, trainer, critical care paramedic, clinical support paramedic, community paramedic.
11. Eligibility – Employees and Officers rule
The AEAWA shall consist of an unlimited number of members who are employed by the AEAWA to assist with its operations.
For the avoidance of doubt and without limiting the above, an Officer of the AEAWA elected or appointed under these rules who ceases their employment in the industry referred to in Rule 9 or an occupation referred to in 10 remains eligible to be a member of the AEAWA if they are employed by the AEAWA.
12. Eligibility – Provision for independent contractors
The AEAWA shall consist of an unlimited number of members who are independent contractors but would otherwise be eligible under Rules 9 or 10 if they were instead engaged as an employee and performing the work of the kind which they usually perform as an independent contractor.
13. Interpretation of the eligibility rules
Rules 9, 10, and 11 shall be interpreted separately. Accordingly:
- Rule 9 shall not limit nor be limited by Rules 10, or 11.
- Rule 10 shall not limit nor be limited by Rules 9 or 11.
- Rule 11 shall not limit nor be limited by Rules 9 or 10.
Rule 12 shall be interpreted as expanding the scope of Rules 9 and 10.”
Any interested organisation registered under the Fair Work (Registered Organisations) Act 2009, association or person who desires to object to the application may do so by lodging with the Fair Work Commission, marked to the attention of the Registered Organisations Services Branch, a notice of objection, complying with the requirements of regulation 14 of the Fair Work (Registered Organisations) Regulations 2009, no later than thirty-five (35) days after the publication of this advertisement and by serving on the organisation, whose address for service is: PO Box 1290, Canning Bridge Applecross, WA 6153 within seven (7) days after the notice of objection has been lodged, a copy of the notice of objection so lodged.
This notice is published pursuant to regulation 22 of the Fair Work (Registered Organisations) Regulations 2009.
