Overview

The Hazardous Waste (Regulation of Exports and Imports) Act 1989 was enacted to address the problem of the export and import of hazardous waste, ensuring that these activities do not pose unnecessary risks to human health or the environment. This Act was introduced by the Australian Parliament to establish a regulatory framework that governs the movement of hazardous waste across international borders. Its policy objective is to protect human health and the environment from the potential hazards associated with the transboundary movement of hazardous waste by ensuring that such movements are conducted in a manner that minimises risks. The Act empowers the Department of the Environment and Energy to assess and approve or reject applications for the export and import of hazardous waste, based on the potential environmental and health impacts.

Scope and Application

The Hazardous Waste (Regulation of Exports and Imports) Act 1989 applies to the movement of hazardous waste across international borders, with a specific focus on exports and imports within Australia and its territories. The Act mandates that any entity or individual seeking to export or import hazardous waste must apply for and obtain a permit from the Department of the Environment and Energy. This requirement ensures that the movement of hazardous waste adheres to stringent environmental and safety standards. The Act encompasses various types of hazardous waste, including waste electrical transformers contaminated with polychlorinated biphenyls, as illustrated in the case of Globecare Services' application for the transit of such waste from the Philippines to France. The jurisdictional reach of the Act extends to the Commonwealth level, governing the entire nation and its territories. The application process, as specified in the Act, allows for public consultation, wherein written comments can be submitted within a designated period to the Department. Notably, the Act does not specify exclusions or exemptions, implying that all hazardous waste movements are subject to its provisions unless otherwise determined through subordinate instruments or regulations.

Key Provisions

The key provision of the notice (section 33) of the Hazardous Waste (Regulation of Exports and Imports) Act 1989 informs that an application (AUH16-051) has been received from Globecare Services, Incorporated, concerning the transit of hazardous waste from the Philippines to France. Specifically, the application pertains to the movement of up to 55.5 tonnes of waste electrical transformers contaminated with polychlorinated biphenyls (Basel Code A3180) for incineration at the Tredi Saint-Vulbas facility in France. This notice is intended to provide the public with an opportunity to review and comment on the application, ensuring transparency and public participation in the decision-making process regarding hazardous waste management. The Act imposes several obligations and requirements on the parties involved. Firstly, Globecare Services, Incorporated must submit a detailed application outlining the nature of the waste, the proposed transit route, and the disposal operation at the destination. Additionally, the Department of the Environment and Energy is required to publish this notice to inform the public and allow for written comments. The public has 28 days from the publication date to lodge their comments, which must be directed to the Director of the Hazardous Waste Section, either by mail or email. It is important that these comments are not confidential to ensure the integrity of the review process. Breach of the provisions outlined in the Act may lead to various civil or criminal consequences. For instance, if Globecare Services, Incorporated fails to comply with the requirements for the transit and disposal of hazardous waste, it could be subject to enforcement actions by the Department of the Environment and Energy. Penalties for non-compliance can include fines, and in severe cases, criminal charges could be pursued. The exact penalties are not specified in the notice but can be found in the Hazardous Waste (Regulation of Exports and Imports) Act 1989, which includes provisions for substantial fines and potential imprisonment for serious violations. The public is encouraged to submit their comments within the specified timeframe to ensure their views are considered in the decision-making process regarding the hazardous waste application.
