Overview

The National Capital Plan Draft Amendment 84 (DA84) was enacted in 2013 to address a specific planning need identified by the ACT Government. This amendment concerns the reclassification of certain land areas in Pialligo from Broadacre Areas to Urban Areas, specifically altering the land use policies of part Block 4 Section 9 and part Block 2 Section 12 Pialligo. This change aims to facilitate the future development of these sites as mixed-use industrial zones. The amendment was prepared under sections 15(1) and 23 of the Australian Capital Territory (Planning and Land Management) Act 1988 and is now open for public inspection and comment. Concurrently, the Environment and Sustainable Development Directorate has prepared Draft Variation No. 324 (DV324), proposing to rezone these sites from broadacre to mixed-use industrial to accommodate large bulky goods retailing, freight transport, warehousing, and distribution operations. Public consultations on both DA84 and DV324 are being managed in a streamlined manner to ensure efficient feedback collection from the community.

Scope and Application

The Draft Amendment 84 to the National Capital Plan, concerning sections 9 and 12 of the Pialligo block, aims to alter the land use policy from Broadacre Areas to Urban Areas in response to a request from the ACT Government. This amendment, prepared under sections 15(1) and 23 of the Australian Capital Territory (Planning and Land Management) Act 1988, is designed to facilitate future development into a mixed-use industrial zone. The amendment is available for public inspection and comment and is being concurrently consulted with Draft Variation No. 324, which proposes re-zoning the site from broadacre to mixed-use industrial to support large-scale operations such as bulky goods retailing, freight transport, warehousing, and distribution. This legislative amendment applies to entities and individuals interested in the Pialligo block, specifically those intending to engage in urban and industrial development within the Australian Capital Territory. The amendment extends its jurisdiction within the boundaries of the ACT and is subject to the provisions of the Australian Capital Territory (Planning and Land Management) Act 1988. No specific exclusions or thresholds are mentioned in the document, but public submissions are encouraged through specified email, mail, and in-person delivery options.

Key Provisions

The National Capital Plan Draft Amendment 84 (DA84) focuses on altering the land use policies for specific areas in Pialligo. Specifically, sections 9 Part Block 4 and 12 Part Block 2 are set to change from Broadacre Areas to Urban Areas, as indicated in the legislation. This amendment is a response to a request by the ACT Government to facilitate the future development of these sites as a mixed-use industrial zone. According to sections 15(1) and 23 of the Australian Capital Territory (Planning and Land Management) Act 1988, DA84 has been prepared and is now available for public inspection and comment. The Environment and Sustainable Development Directorate (ESDD) has concurrently prepared Draft Variation (DV) No.324, which proposes rezoning the site opposite Majura Park from broadacre (NUZ1) to mixed-use industrial (IZ2). This rezoning aims to allow for large bulky goods retailing, freight transport, warehousing, and distribution operations on the site. The obligations imposed by DA84 and DV324 primarily revolve around the consultation process. The ACT Government and the National Capital Authority (NCA) are committed to simplifying the public consultation process by handling both DA84 and DV324 concurrently. A public information session has been scheduled for Thursday, 24 October 2013, from 1:00 pm to 2:00 pm at the National Capital Authority, Ground Floor Treasury Building, King Edward Terrace, Parkes ACT 2600. This session provides an opportunity for stakeholders and the public to review and comment on the draft amendments and variations. Submissions can be made via email, mail, or in person, with specific contact details provided for each method. Additionally, copies of DA84 are available for public access at various locations and online. The legislation outlines potential breaches and associated consequences for non-compliance. Although specific offences and penalties are not detailed in the provided text, the Act generally stipulates that failure to comply with planning and land management provisions can result in both civil and criminal penalties. These may include fines, imprisonment, or other legal repercussions, depending on the severity and nature of the breach. The exact penalties would typically be found in the main body of the Australian Capital Territory (Planning and Land Management) Act 1988 or related subsidiary legislation. Public participation is encouraged to ensure that all voices are heard before final decisions are made.
