Overview

The Australian Capital Territory (Planning and Land Management) Act 1988 was enacted to provide for the planning and sustainable management of land and development within the Australian Capital Territory. This Act was introduced to address the need for a comprehensive framework that balances development with the preservation of the Territory's unique environment and cultural heritage. The policy objective of the Act is to promote sustainable land use and development that ensures the well-being of the community while protecting the natural and built environment. Draft Amendment 82 to the National Capital Plan, specifically concerning the Amtech Estate in Symonston, seeks to amend the existing provisions to allow a broader range of industrial uses, aligning with the Territory Plan, while mitigating potential conflicts and adverse impacts, particularly from hazardous industries. This amendment also proposes to remove the ‘Special Requirements’ specific to the Amtech Estate, aiming to streamline regulatory measures and facilitate more flexible industrial operations within the estate. The Draft Amendment is currently open for public inspection and comment, with a public information session hosted by the National Capital Authority on 17 July 2013, and written submissions accepted until 14 August 2013.

Scope and Application

Draft Amendment 82 to the National Capital Plan, specifically concerning the Amtech Estate in Symonston, seeks to modify the existing provisions to allow a broader range of industrial uses in line with the Territory Plan. This amendment aims to manage potential conflicts and adverse impacts within the estate, such as those associated with hazardous industries. Additionally, the amendment proposes the removal of the 'Special Requirements' that are currently specific to the Amtech Estate. This proposal is crafted in compliance with sections 15(1) and 23 of the Australian Capital Territory (Planning and Land Management) Act 1988, and is now open for public inspection and feedback. The National Capital Authority will be hosting a public information session on this draft amendment at their office in Parkes on 17 July 2013, with a call for written comments by 14 August 2013. Stakeholders can submit their views via email or the NCA’s Have Your Say website, and hard copies of the draft amendment are accessible at specified locations in Canberra. This amendment reflects the NCA's commitment to transparent and inclusive planning processes in the Australian Capital Territory.

Key Provisions

The main provisions of Draft Amendment 82 (DA82) to the National Capital Plan aim to modify the existing regulations concerning the Amtech Estate in Symonston. Specifically, section 15(1) and section 23 of the Australian Capital Territory (Planning and Land Management) Act 1988 outline the amendment's intent to allow a broader range of industrial uses within the estate, provided they are consistent with the Territory Plan and do not cause significant conflicts or adverse impacts, such as those associated with hazardous industries. Additionally, the draft amendment proposes the removal of the ‘Special Requirements’ that currently apply specifically to the Amtech Estate. These changes are designed to update the plan to better reflect current industrial needs while maintaining safety and environmental standards. DA82 imposes several obligations and requirements on parties involved with the Amtech Estate. Firstly, it mandates public consultation, inviting interested individuals and organisations to review the draft amendment and provide written feedback by 14 August 2013. The National Capital Authority (NCA) is responsible for overseeing this process and will host a public information session on 17 July 2013 at their offices in Parkes to discuss the draft amendment. Additionally, the NCA will collect and consider all submissions received during the public consultation period to inform their final decision on the amendment. Failure to comply with the provisions outlined in DA82 could result in various consequences. Although the legislation does not explicitly state penalties for non-compliance, breaches of planning regulations generally can lead to enforcement actions under the Australian Capital Territory (Planning and Land Management) Act 1988. These actions might include fines, injunctions, or other legal measures to compel compliance with the approved plan. Additionally, significant non-compliance could result in civil or criminal liability depending on the nature and extent of the breach, potentially leading to further penalties or legal proceedings.
