Overview

The Lands Acquisition Act 1989 was enacted by the Parliament of the Commonwealth of Australia to provide a framework for the acquisition of land by the Commonwealth. This Act was introduced to address the need for a clear and efficient process for acquiring land, ensuring that the Commonwealth can secure land necessary for public purposes, including infrastructure projects, defence, and other essential services. The policy objective of the Act is to facilitate the acquisition of land while providing fair compensation to landowners and ensuring the process is transparent and just. This particular notice, issued under the authority of the Minister for Finance, serves to extinguish a specific easement related to Lot 1009 in Deposited Plan 75824 SA, which is located in Smithfield Hundred of Munno Para, South Australia. The easement in question pertains to the excavation, construction, maintenance, and repair of pipes for sewerage purposes on land marked D on F257437. By extinguishing this easement, the Commonwealth aims to resolve any conflicts or complications arising from the easement, thereby allowing for the continued development and use of the land in a manner consistent with public needs and objectives.

Scope and Application

The Lands Acquisition Act 1989 applies to the extinguishment of rights and interests in land by the Commonwealth of Australia. This particular gazette notice pertains to the extinguishment of an easement specifically related to Lot 1009 in Deposited Plan 75824 in the Smithfield Hundred of Munno Para, South Australia. The easement in question involves the Commonwealth's rights for sewerage purposes over the land marked D on F257437. The notice is issued under the authority of a delegate of the Minister for Finance, as permitted by subsection 123(1) of the Act. The extinguishment is geographically confined to the specified lot within the state of South Australia, and no exemptions or exclusions are mentioned in the notice. The Act allows for the extension or restriction of its application through subordinate instruments, although such details are not elaborated upon in this particular gazette.

Key Provisions

The main operative sections of the Lands Acquisition Act 1989, as evidenced in the notice published in Gazette C2024G00769, involve the extinguishment of an easement on Lot 1009 in Deposited Plan 75824 in the Smithfield Hundred of Munno Para, South Australia (section 123(1)). The notice specifies that the easement, which was owned by the Commonwealth of Australia, has been extinguished by Raymond Leslie McInnes, the delegate of the Minister for Finance. This easement related to the excavation, construction, laying, use, examination, alteration, repair, renewal, and maintenance of pipes for sewerage purposes on the land marked D on F257437 (T 3690219). The Act imposes specific obligations on the parties involved. The delegate of the Minister for Finance is authorised to extinguish easements where it is deemed necessary or beneficial for the Commonwealth's interests. In this case, Raymond Leslie McInnes has exercised this authority by formally signing and issuing the notice, thereby legally extinguishing the specified easement. This action likely follows a formal review or decision-making process that considers the implications of extinguishing such an easement for public or Commonwealth benefit. There are potential consequences for breaches of the provisions outlined in the Act. While the notice itself does not specify particular offences, penalties, or civil/criminal consequences for non-compliance, the Act generally provides for legal actions to enforce the decisions made under it. In the event of a dispute or challenge to the extinguishment of the easement, the party aggrieved may seek judicial review or other legal remedies to contest the decision. However, the specific penalties or consequences for such breaches would depend on the broader legal context and any relevant case law. The Act ensures that the extinguishment process is legally sound and enforceable, maintaining the integrity of land acquisition and management under Commonwealth law.
