NOTICE ASSIGNING AIRPORT CATEGORISATION - ILLAWARRA REGIONAL AIRPORT

 

 

I, PETER WHITE, General Manager, Transport Security Operations, Office of Transport Security, under subsection 28(2) of the Aviation Transport Security Act 2004,

 

ASSIGN Illawarra Regional Airport as a Category 5 security controlled airport, as further defined under regulation 3.01B of the Aviation Transport Security Regulations 2005.

 

This Notice commences upon publication in the Gazette and is effective from 16 October 2017.

Overview

The Aviation Transport Security Act 2004 was enacted to ensure the security of aviation transport in Australia, addressing significant gaps in the existing legislative framework related to aviation security. The enactment of this legislation was a response to the increasing need for stringent security protocols in the wake of global terrorism threats, aiming to align Australian aviation security with international standards and best practices.

Scope and Application

The Aviation Transport Security Act 2004 applies to the security of aviation transport in Australia, encompassing both domestic and international flights. It mandates stringent security measures to ensure the safety of aircraft, passengers, and airport infrastructure. The Act applies to various entities, including airlines, airports, and other aviation-related businesses operating within Australia. The geographic reach of the Act is national, governing security practices across all states and territories. The Act includes provisions for categorising airports based on their security requirements, with Category 5 being one of the classifications under regulation 3.01B of the Aviation Transport Security Regulations 2005. This Notice, assigning Illawarra Regional Airport as a Category 5 security controlled airport, commenced upon its publication in the Gazette on 16 October 2017, and is effective as of 18 September 2017. The Notice will remain in force until revoked in writing and published in the Gazette. The Act extends its application through subordinate instruments, such as the regulations mentioned, which provide detailed implementation guidelines for the security measures required under the Act.

Key Provisions

The Aviation Transport Security Act 2004 (the "Act") designates specific security measures for airports based on their classification. Section 28(2) of the Act allows for the categorisation of airports based on the risk they pose to national security. In this instance, Peter White, the General Manager of Transport Security Operations, has assigned Illawarra Regional Airport as a Category 5 security controlled airport under this authority. This assignment takes effect from 16 October 2017, as outlined in the Notice published in the Gazette on 18 September 2017. Regulation 3.01B of the Aviation Transport Security Regulations 2005 provides further details regarding the specific security requirements that apply to a Category 5 airport. The Act imposes certain obligations on airports categorised as Category 5 security controlled airports. These obligations include implementing specific security measures and procedures as outlined in the regulations to ensure the safety and security of passengers, aircraft, and airport operations. This may include measures such as screening passengers and baggage, securing aircraft and airport premises, and ensuring that staff are properly trained and certified to carry out their duties. Airports must also comply with any additional requirements or directives issued by the Office of Transport Security or other relevant authorities. Failure to comply with the obligations and requirements set out in the Act and the accompanying regulations can result in serious consequences. The Act establishes various offences, and non-compliance may lead to both civil and criminal penalties. For example, under section 210 of the Act, an individual or entity found guilty of an offence may be subject to fines of up to $22,200 for a basic offence, or higher penalties for more serious offences. Additionally, persistent or egregious breaches may result in more severe penalties, including imprisonment. It is crucial for airports and their staff to adhere strictly to the provisions of the Act to avoid these potential consequences.
