Overview

The Northern Territory National Emergency Response (Town Camps) Declaration 2007 (No. 2) was enacted to address issues within certain town camps in the Northern Territory, as part of a broader legislative framework known as the Northern Territory National Emergency Response Act 2007. This legislative instrument was made under subsection 4(3) of the aforementioned Act by the Australian Government, specifically the Department of Families, Housing, Community Services and Indigenous Affairs. The objective of this declaration was to identify specific town camps as prescribed areas, thereby enabling targeted interventions to address social and economic challenges faced by Indigenous communities in these locations. The declaration came into effect following its registration and has been amended since its initial enactment to reflect changes in circumstances or policy directions.

Scope and Application

The Northern Territory National Emergency Response (Town Camps) Declaration 2007 (No. 2), as amended, applies to specific town camps within the Northern Territory, designated as prescribed areas under the Northern Territory National Emergency Response Act 2007. This legislation is intended to address particular concerns in these areas, and it targets the conduct and transactions occurring within these prescribed town camps, aiming to ensure compliance with broader national emergency response measures. The geographic reach of this legislation is confined to the Northern Territory, and it specifically identifies certain town camps through the Schedule attached to the Declaration. Any exclusions, exemptions, or thresholds pertinent to this Act are not explicitly detailed within the provided text; however, it is noted that the application of this legislation can be extended or restricted through subordinate instruments, which would provide further clarity on these aspects. The Declaration came into effect on the day following its registration and has been subject to amendments, such as the Northern Territory National Emergency Response (Town Camps) Amendment Declaration 2007 (No. 1), which was registered and commenced on a subsequent date. This legislative instrument is part of a larger framework designed to respond to emergencies in specific regions, and its provisions are applicable to the identified town camps as listed in the attached Schedule. The legislative instrument was prepared by the Legal Services Branch, Department of Families, Housing, Community Services and Indigenous Affairs, Canberra, and it was compiled considering amendments up to the specified date.

Key Provisions

The Northern Territory National Emergency Response (Town Camps) Declaration 2007 (No. 2) designates specific areas as prescribed town camps under the Northern Territory National Emergency Response Act 2007. This Declaration, which is a legislative instrument, specifies which town camps fall under the category of prescribed areas as mentioned in section 4(2)(d) of the Act (section 3). The declaration identifies the town camps by name, aliases, parcel numbers, and titles where applicable, as detailed in the Schedule. These designated areas are crucial for the purposes of implementing measures outlined in the Act to address emergency situations within these specific locales. Entities and individuals subject to the Act are required to adhere to the regulations and measures applicable to these prescribed areas. The obligations imposed by the Act could include compliance with certain housing, health, and welfare standards or other emergency-related protocols. These requirements are intended to ensure the safety, health, and welfare of individuals residing in these town camps, and to address any emergencies that may arise within these areas. Failure to comply with the provisions of the Act, or with the measures and regulations specific to the prescribed town camps, may result in legal consequences. While the specific offences, penalties, or civil/criminal consequences are not detailed in this particular Declaration, under the Northern Territory National Emergency Response Act 2007, breaches of the Act can lead to significant penalties. These penalties could include fines or imprisonment, depending on the nature and severity of the breach. The Act empowers authorities to take necessary actions to enforce compliance, ensuring that the measures in place are effectively implemented and maintained.
