Overview
Statutory Rules 1949 No. 0077, enacted under the Northern Territory (Administration) Act 1910-1947, addresses the need for amendments to the Northern Territory Legislative Council (Fees and Expenses) Regulations. The Governor-General, acting on advice from the Federal Executive Council, introduced these regulations to adjust the fees and expenses payable to elected members of the Legislative Council, thereby ensuring that they are adequately compensated for their services. This legislative instrument was designed to provide clarity and updated financial provisions in response to the operational requirements of the Legislative Council, reflecting the evolving administrative needs of the Northern Territory.
Scope and Application
The Northern Territory (Administration) Act 1910-1947 is the legislative basis for these Regulations which primarily concern the fees and expenses of members of the Northern Territory Legislative Council. The Regulations apply to elected members of the Council and aim to adjust the fees and expenses they are entitled to receive. The amendments to the Northern Territory Legislative Council (Fees and Expenses) Regulations specify changes to the fees payable to members for attending meetings and their travel expenses. For instance, the Regulations increase the daily fee for attending meetings and adjust the travel expenses for attending meetings. These Regulations have a specific geographic and jurisdictional reach within the Northern Territory, as they govern the administrative functions and financial entitlements of the Legislative Council within that region. The Regulations do not specify any exclusions or exemptions but provide a clear outline of who is covered—elected members of the Council. The Regulations are intended to take effect on specific dates, as indicated within the document, to ensure a structured implementation of the amendments.
Key Provisions
The Regulations under the Northern Territory (Administration) Act 1910-1947, as amended, pertain specifically to the fees and expenses associated with the Northern Territory Legislative Council. Regulation 1a defines the term 'meeting' to mean a gathering of the Council or a Select Committee appointed by the Council. Regulation 2 modifies the fee structure for elected members of the Council, raising the fee from three pounds three shillings to four pounds four shillings. Additionally, it specifies that a fee of four pounds four shillings is payable for any day an elected member leaves home before midday or returns home after midday following attendance at a meeting. Regulation 3 adjusts the travelling expenses for Council members, increasing the allowance from one pound ten shillings to two pounds for attendance at meetings, with the location of the meeting replacing the specific mention of travel to Darwin.
These Regulations impose clear financial obligations on elected members of the Northern Territory Legislative Council, ensuring that they receive compensation for their time and travel related to their duties. The amendments specify that members are entitled to a higher daily fee and increased travel expenses, which must be adhered to by the administration of the Council. The Regulations mandate that these financial adjustments are to be implemented as of specified dates in 1948, ensuring a timely and structured transition to the new fee structure.
Violations of the financial provisions outlined in these Regulations may lead to legal consequences. While the specific penalties are not detailed within the text, breaches of statutory obligations typically result in financial restitution, fines, or other administrative actions as determined by relevant authorities. The Regulations are designed to provide clarity and enforceability regarding the compensation of Council members, ensuring that the administration complies with the stipulated financial terms.
