Overview

The Statutory Rules 1967 No. 17, made under the Northern Territory Representation Act 1922-1959, the Northern Territory (Administration) Act 1910-1965, and the Commonwealth Electoral Act 1918-1966, were introduced to amend the Northern Territory Electoral Regulations in response to the transition to decimal currency in Australia. Enacted by the Governor-General on behalf of the Federal Executive Council, these regulations aimed to align electoral procedures and penalties with the new monetary system. The primary objective was to ensure that the legal framework governing elections in the Northern Territory remained consistent and effective post-decimalisation. The regulations included amendments to various forms and provisions within the Northern Territory Electoral Regulations to replace outdated currency denominations with the new decimal currency equivalents. These changes were necessary to maintain the clarity and enforceability of electoral laws, ensuring that the administration of elections in the Northern Territory continued smoothly without confusion or discrepancies arising from the change in currency.

Scope and Application

The Statutory Rules 1967 No. 17 made under the Northern Territory Representation Act 1922-1959, the Northern Territory (Administration) Act 1910-1965, and the Commonwealth Electoral Act 1918-1966, are directed towards the regulation of electoral matters within the Northern Territory. These regulations amend the Northern Territory Electoral Regulations to align with changes in currency from pre-decimal to decimal currency. This legislative instrument applies to electors within the Northern Territory who are involved in electoral processes and the officials managing these processes. The amendments cover various aspects of the electoral regulations including forms used in the electoral process, such as Form 2, Form 8, Form 9, Form 10, Form 11, Form 16, and Form 21, ensuring that all references to monetary penalties and fees are updated to reflect decimal currency. Additionally, it includes changes to the manner in which postal votes are to be scrutinised preliminarily. The regulations extend the application of these electoral laws within the jurisdictional boundaries of the Northern Territory, ensuring uniformity and compliance with national electoral standards. No specific exclusions, exemptions, or thresholds are mentioned in the text, and the application of these regulations is comprehensive within the specified context.

Key Provisions

The key provisions of the Statutory Rules 1967 No. 17 involve amendments to the Northern Territory Electoral Regulations under the Northern Territory Representation Act 1922-1959, the Northern Territory (Administration) Act 1910-1965 and the Commonwealth Electoral Act 1918-1966. The regulations primarily concern changes to various forms used in the electoral process, as well as adjustments to the monetary penalties associated with electoral offences. Regulation 96 modifies the eligibility criteria for voters, while Regulation 116 introduces additional requirements for the preliminary scrutiny of postal votes (Regulations 1 and 2). The First Schedule includes amendments to Forms 2, 8, 9, 10, 11, 16, 21, 22, and 31, which update the language and structure to reflect the decimal currency system in Australia (Regulation 3). Regulation 11 also updates monetary penalties in the Electoral Regulations to align with decimal currency (Regulation 11). These amendments impose several obligations on the parties involved in the electoral process. For instance, Regulation 96 requires electors to meet specific criteria for eligibility, while Regulation 116 imposes additional scrutiny on postal votes to ensure their validity. Furthermore, the updated forms in the First Schedule mandate clear and precise information to be provided by voters, witnesses, and other relevant parties. The forms require accurate personal details, declarations, and consents to be filled out in a specific manner, ensuring the integrity of the electoral process. Additionally, the updated monetary penalties in Regulation 11 reflect the decimal currency system, ensuring that fines and penalties are accurately calculated and imposed. Failure to comply with these regulations may result in various consequences, both civil and criminal. For instance, providing false information on any of the updated forms (such as Forms 2, 8, 9, 10, 11, 16, 21, 22, and 31) could lead to legal action, with penalties as outlined in the regulations. Regulation 11 updates the monetary penalties associated with electoral offences, ensuring that fines are appropriately calculated under the decimal currency system. While the specific maximum penalties are not detailed in the provided text, it is likely that breaches of these regulations could result in fines or other legal repercussions as stipulated by the respective Acts under which these Regulations are made.
