Overview

The Norfolk Island Standard Time Ordinance 2015, made under section 19A of the Norfolk Island Act 1979, establishes the standard and daylight saving time for Norfolk Island. This legislative instrument was enacted to standardise timekeeping on the island, addressing the need for a uniform time system that aligns with the practices of other Australian territories and international standards. The Ordinance was issued by the Norfolk Island Legislative Assembly and aims to ensure consistency in legal and administrative time references on the island. It defines standard time as 11 hours ahead of Coordinated Universal Time (UTC) and daylight saving time as one hour ahead of standard time during specified periods. The Ordinance further provides the Minister with the authority to declare a daylight saving period, allowing flexibility to adjust for seasonal variations in daylight. The objective is to streamline legal and administrative processes by providing clear guidelines on the interpretation and application of time references in legal instruments.

Scope and Application

The Norfolk Island Standard Time Ordinance 2015 applies to Norfolk Island and sets the standard time and daylight saving time for the island. This legislation applies to all persons, entities, and conduct occurring on Norfolk Island. The geographic jurisdiction of this Act is limited to Norfolk Island, which is a territory of Australia. The Act specifies that standard time in Norfolk Island is 11 hours in advance of Coordinated Universal Time (UTC). Furthermore, during the daylight saving period, which is defined as starting at 2 am on the first Sunday in October and ending at 2 am on the first Sunday in the following April, Norfolk Island observes daylight saving time, which is one hour in advance of the standard time. The Act also mandates that unless otherwise specified, references to time in legal instruments should be interpreted using either the standard time or the daylight saving time, depending on the period in question. The application of this legislation can be further extended or modified through subordinate instruments, such as legislative instruments issued by the Minister, which can declare different daylight saving periods. The scope of the Norfolk Island Standard Time Ordinance 2015 is explicitly confined to the matters of timekeeping on Norfolk Island, and it does not extend to other territories or jurisdictions. The Act excludes the application of the Acts Interpretation Act 1901, indicating that the Interpretation Act 1979 (Norfolk Island) governs the interpretation of this Ordinance. There are no specified exemptions or thresholds in the text provided, and any amendments or modifications to the Act are detailed in the endnotes of the compilation, which include information on amending laws, application, saving, and transitional provisions, as well as the amendment and legislation histories.

Key Provisions

The Norfolk Island Standard Time Ordinance 2015 (the Ordinance) establishes the time standards for Norfolk Island. It sets out the standard time and daylight saving time for the island (sections 6 and 7). The standard time in Norfolk Island is 11 hours in advance of Coordinated Universal Time (UTC). During the daylight saving period, the time is 1 hour in advance of the standard time. The Ordinance also clarifies how references to time in legal instruments should be interpreted, specifying that unless otherwise indicated, times should be understood according to either standard time or daylight saving time, depending on the period (section 8). The Ordinance imposes obligations on parties and entities to adhere to the specified time standards when recording or referencing time in legal instruments. This includes ensuring that any legal document or agreement specifies the time according to either standard time or daylight saving time as applicable, unless the context clearly indicates otherwise (section 8). Furthermore, the Ordinance provides the Minister with the authority to declare a daylight saving period through a legislative instrument, thus allowing for flexibility in adjusting the daylight saving period as needed (section 4A). There are no explicit offences or penalties mentioned within the Ordinance for non-compliance with its provisions. However, failing to adhere to the specified time standards could potentially lead to disputes or ambiguities in legal instruments, which could be resolved through interpretation or court proceedings. It is important for parties to carefully consider the time references in their legal agreements to avoid such issues.
