Overview
The Norfolk Island Legislative Assembly (Temporary Clerk) Regulations, made under the Norfolk Island Act 1979, were enacted to address the need for interim administrative support for the Norfolk Island Legislative Assembly during the transitional period before a permanent Clerk could be appointed. The Regulations were made by the Governor-General, acting on the advice of the Federal Executive Council, and came into operation on a date specified under the Norfolk Island Act 1979. The primary policy objective of these Regulations is to ensure that the Legislative Assembly can function effectively by providing temporary administrative support, thereby maintaining legislative continuity and governance on Norfolk Island until a permanent Clerk is appointed.
Scope and Application
The Norfolk Island Legislative Assembly (Temporary Clerk) Regulations 1979 are made under the Norfolk Island Act 1979 and apply specifically to the appointment and functions of temporary clerks and deputy temporary clerks to the Norfolk Island Legislative Assembly. These Regulations are designed to ensure the smooth operation of the Legislative Assembly during a transitional period until a permanent clerk is appointed. The Minister of State for Home Affairs has the authority to appoint individuals to these temporary roles, and these appointees will perform the powers, functions, and duties as determined by the Minister until a permanent clerk is appointed or the Legislative Assembly otherwise directs. The geographic reach of these Regulations is confined to Norfolk Island, a territory of Australia, and they do not extend beyond this jurisdiction. There are no stated exclusions, exemptions, or thresholds within these Regulations, and their application is direct and straightforward without reliance on subordinate instruments for extension or restriction.
Key Provisions
The Norfolk Island Legislative Assembly (Temporary Clerk) Regulations establish the framework for the appointment and roles of temporary clerks for the Norfolk Island Legislative Assembly. Section 3(1) allows the Minister to appoint a temporary clerk to the Legislative Assembly. This temporary clerk will act as the Clerk until a permanent Clerk is appointed under the Legislative Assembly Ordinance 1979. The temporary clerk's powers, functions, and duties are determined by the Minister until otherwise specified by the Legislative Assembly. Section 3(3) similarly permits the appointment of a deputy temporary clerk to assist the temporary clerk in exercising and performing the temporary clerk's powers, functions, and duties.
These Regulations impose several obligations on the Minister and the appointed temporary clerk. The Minister must ensure that a temporary clerk is appointed to manage the Legislative Assembly's affairs in the interim period. The temporary clerk, upon appointment, assumes the responsibilities and authorities necessary for the proper functioning of the Legislative Assembly until a permanent Clerk is appointed. Additionally, the deputy temporary clerk is tasked with assisting the temporary clerk, ensuring continuity and efficiency in the Legislative Assembly's operations.
Failure to comply with the provisions of these Regulations may lead to legal consequences, although the specific offences and penalties are not detailed within the text. Generally, breaches of regulations such as these may result in civil or criminal penalties, depending on the nature and severity of the breach. The exact penalties could be outlined in other related legislation or regulations, but they are not specified in this particular legislative instrument. However, the overarching legislation, the Norfolk Island Act 1979, would provide further guidance on the penalties for non-compliance with regulations made under it.
