Explanatory Statement

Amendment of Norfolk Island (Exercise of Powers) Regulations Statutory Rules 1984 No. 33

(Issued under the authority of the Minister of State for Territories and Local Government)

This Statutory Rule will repeal regulation 2 of the Norfolk Island (Exercise of Powers) Regulations and re-make that regulation to insert a provision excluding from the operation of item 42 of Schedule 2 of the Norfolk Island Act 1979 any matter that relates to immigration or the operation of the Immigration Act 1980 of the Territory.

Overview

The Statutory Rules 1984 No. 33, issued under the authority of the Minister of State for Territories and Local Government, amends the Norfolk Island (Exercise of Powers) Regulations 1984 to address a specific issue concerning the application of Norfolk Island legislation to immigration matters. This legislative amendment was introduced to ensure that immigration-related matters are governed by the Immigration Act 1980 of the Territory rather than Norfolk Island legislation. The policy objective is to clarify the jurisdictional boundaries between Norfolk Island and the Territory in relation to immigration matters, thereby avoiding any potential conflicts or overlaps in the exercise of powers.

Scope and Application

The Norfolk Island (Exercise of Powers) Regulations 1984, as amended by Statutory Rule F1996B02067, primarily apply to the governance and administration of Norfolk Island, affecting the manner in which powers are exercised by the Norfolk Island Administration under the Norfolk Island Act 1979. This regulation specifically targets the exclusion of immigration matters from the scope of certain administrative actions, thereby restricting the applicability of item 42 of Schedule 2 of the Norfolk Island Act 1979 to exclude immigration-related issues. The regulation applies to all persons and entities involved in the administration of Norfolk Island, including local government officials and other authorities executing powers on the island. Its jurisdictional reach is confined to Norfolk Island itself, as it pertains to the local governance and powers exercised there. The amendment ensures that any actions or decisions concerning immigration are governed solely by the provisions of the Immigration Act 1980 of the Territory, rather than being subject to the broader administrative powers outlined in the Norfolk Island Act 1979.

Key Provisions

The main operative sections of this Statutory Rule are the repeal and re-making of regulation 2 of the Norfolk Island (Exercise of Powers) Regulations (paragraph 1). Specifically, this Statutory Rule repeals the existing regulation 2 (subsection 1(1)) and then re-makes it to include a new provision (subsection 1(2)). This new provision excludes from the operation of item 42 of Schedule 2 of the Norfolk Island Act 1979 any matter that relates to immigration or the operation of the Immigration Act 1980 of the Territory (subsection 1(2)(a)-(b)). The obligations and requirements imposed by this Statutory Rule are primarily directed towards ensuring that the Norfolk Island (Exercise of Powers) Regulations accurately reflect the legislative intent concerning immigration matters. By excluding immigration-related matters from the scope of item 42 of Schedule 2 of the Norfolk Island Act 1979, the Statutory Rule clarifies that these matters will not be subject to certain powers or actions unless explicitly authorised by other legislation. This exclusion helps maintain a clear delineation between Norfolk Island's legislative powers and the federal government's authority over immigration. The Statutory Rule does not explicitly detail offences or penalties for non-compliance with its provisions, but it is reasonable to infer that any actions taken under the mistaken belief that immigration matters are covered by item 42 could be subject to legal challenge or correction. The primary consequence of such a misinterpretation would be the potential for legal disputes or the need for corrective measures to align with the correct legal framework. The Norfolk Island Act 1979 and the Immigration Act 1980 would govern the handling of any such issues, and penalties would be determined according to the provisions of those Acts. The intent behind this Statutory Rule appears to be to clarify jurisdictional boundaries and avoid potential conflicts between Norfolk Island's legislative powers and the federal government's immigration authority. By explicitly excluding immigration matters from the scope of certain powers under the Norfolk Island Act 1979, the Statutory Rule aims to prevent unintended consequences or overreach by Norfolk Island authorities in areas that are explicitly federal responsibilities. This ensures that both Norfolk Island and the federal government can operate within their respective jurisdictions without interference.
