Norfolk Island Employment (Show Day) Declaration 2017
Authority
Section 9(2) of the Employment Act 1988 (NI) provides that the Commonwealth Minister is to declare a specified day of a year to be Show Day.
The Norfolk Island Employment (Show Day) Declaration 2017 is made under section 9(2) of the Employment Act 1988 (NI).
The Administrator of Norfolk Island is a delegate of the Commonwealth Minister for the purposes of subsection 9(2) of the Employment Act 1988 (NI) under the Minister’s Norfolk Island Delegation Instrument 2017 (No.1).
Purpose and Operation
The purpose of this instrument is to declare a day to be Show Day in accordance with subsection 9(2) of the Employment Act 1988 (NI), in order for that day to be a public holiday on Norfolk Island. This instrument prescribes the day which Show Day will be observed to provide certainty for the observance of the day on Norfolk Island.
Consultation
There has been consultation with the organisers of the Norfolk Island Royal Agricultural and Horticultural Show. The organisers have confirmed Show Day will be held the second Monday of October.
Statement of compatibility with human rights
This instrument was prepared in accordance with section 9 of the Human Rights (Parliamentary Scrutiny) Act 2011.
This instrument is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 as it does not engage with or raise any human rights issues.
Detailed description of the Declaration
Section 1 – Name of Instrument
Section 1 provides that the name of this instrument is the Norfolk Island Employment (Show Day) Declaration 2017.
Section 2 – Commencement
Section 2 provides that the whole of this instrument will commence on the day after this instrument is registered.
Section 3 – Authority
Section 3 provides that this instrument is made under subsection 9(2) of the Employment Act 1988 (NI).
Section 4 – Declaration of a Public Holiday on Norfolk Island
Section 4 provides that, from the commencement of this instrument, the second Monday in October is Show Day. It will be observed as a public holiday for the purposes of the Employment Act 1988 (NI).
