Overview

The Telecommunications Act 1997 was enacted to regulate telecommunications services in Australia, ensuring efficient and reliable communications infrastructure. One of the key issues this Act addresses is the need for a robust framework to manage and govern the telecommunications industry, including the designation of specific carriers for certain network operations. The Australian Parliament established this Act to create a comprehensive legislative environment that supports the development and maintenance of telecommunications networks, while also protecting consumer interests and promoting competition within the sector. The overarching policy objective of the Act is to facilitate the provision of efficient and high-quality telecommunications services to the Australian public, while ensuring that carriers comply with statutory obligations and standards. The Act empowers the Australian Communications and Media Authority (ACMA) to make declarations that designate specific carriers for particular network operations, such as the nomination of Telstra Corporation Limited as the designated carrier for certain fibre optic cable networks in the Marble Bar region of Western Australia.

Scope and Application

The Telecommunications Act 1997 governs the telecommunications industry in Australia, with a focus on regulating and ensuring the efficient operation of telecommunications services. The Act applies to a wide range of entities, including telecommunications carriers, licensees, and service providers, as well as individuals involved in the telecommunications industry. Its jurisdiction spans across the Commonwealth of Australia, encompassing all states and territories. In the specific instance outlined in the Gazette, the Act recognises Telstra Corporation Limited as a nominated carrier in relation to particular network units, which in this case are the core or cores of the fibre optic cables owned by The Pilbara Infrastructure Pty Ltd located in the Marble Bar region of Western Australia. These cables facilitate communications to and from Telstra’s public mobile telephone services network. The declaration of Telstra as a nominated carrier is contingent upon the satisfaction of certain conditions, primarily that Telstra would be able to comply with all related obligations and that the declaration would not hinder the effective administration of the Act or related consumer protection laws. The scope of the Act is further extended through subordinate instruments, which may include regulations and other legislative provisions designed to implement and refine the operation of the primary Act.

Key Provisions

The Telecommunications Act 1997, specifically in subsection 81(1), designates Telstra Corporation Limited as the nominated carrier for the core or cores of the fibre optic cables owned by The Pilbara Infrastructure Pty Ltd in the Marble Bar region of Western Australia. This declaration is made by Dominic Byrne, a delegate of the Australian Communications and Media Authority (ACMA), who is satisfied that Telstra would be able to meet all obligations as a nominated carrier and that this decision will not hinder the administration of the Telecommunications Act 1997, the Telecommunications (Consumer Protection and Service Standards) Act 1999, and related regulations. The nomination means that Telstra is responsible for managing the communication infrastructure provided by the fibre optic cables, ensuring they operate efficiently and comply with relevant laws. Under the Telecommunications Act 1997, the obligations imposed on Telstra as the nominated carrier include ensuring the infrastructure it manages is reliable and meets service standards set forth by the Telecommunications (Consumer Protection and Service Standards) Act 1999. Telstra must maintain the quality of service for the public mobile telephone services network that utilises the fibre optic cables. This entails regular maintenance, upgrades, and compliance with any service standards or consumer protection regulations. Additionally, Telstra is required to keep accurate records and provide necessary information to the ACMA upon request to demonstrate compliance with these obligations. Failure to meet the obligations outlined in the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999 can result in various consequences. The ACMA has the authority to issue penalties for non-compliance, which can include fines and other administrative actions. For specific breaches, the maximum penalties can be substantial, reflecting the importance of maintaining high standards in telecommunications infrastructure. The precise penalties depend on the nature and severity of the breach, but they are designed to ensure that carriers like Telstra maintain the integrity and reliability of the services they provide. Breaches may also lead to civil or criminal proceedings if the violations are severe enough, underscoring the critical importance of adherence to the regulatory framework.
