Overview
The Telecommunications Act 1997 was enacted to establish a comprehensive framework for the regulation of telecommunications in Australia, addressing gaps in previous legislation by providing a unified statutory basis for the administration and oversight of telecommunications services. This Act was introduced to streamline the licensing and operational requirements for telecommunications carriers, ensuring that they comply with national standards and service obligations. The enacting body responsible for this legislation is the Australian Parliament, with the overarching policy objective being to foster a competitive and efficient telecommunications market while safeguarding consumer interests and promoting universal access to telecommunications services.
The declaration made by Dominic Byrne, a delegate of the Australian Communications and Media Authority (ACMA), under subsection 81(1) of the Act, confirms that OptiComm Limited has been designated as the nominated carrier for all network units owned by Oscar Communities Pty Ltd, used to supply carriage services to the public. This designation recognises OptiComm Limited's compliance with the necessary obligations and ensures that the declaration does not hinder the effective administration of the Telecommunications Act 1997 and related consumer protection regulations. The declaration was issued on 9 November 2020, formalising OptiComm Limited's role in providing telecommunications services under the regulatory framework established by the Act.

Key Provisions
The main operative sections of the Telecommunications Act 1997, as evidenced by the declaration, involve the nomination of a carrier, specifically OptiComm Limited, to handle network units for Oscar Communities Pty Ltd (subsection 81(1)). This declaration asserts that OptiComm Limited is well-positioned to meet all obligations as the nominated carrier, ensuring compliance with the Act and related consumer protection standards. Under the Telecommunications Act 1997, OptiComm Limited assumes the role of a nominated carrier for Oscar Communities Pty Ltd, which involves several obligations. These obligations include ensuring that the network units are managed in a way that complies with the statutory requirements of the Act and related legislation. The obligations imposed on OptiComm Limited as the nominated carrier require them to operate within the legal framework established by the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999. For instance, under section 279 of the Act, a person can be fined up to $522,200 for contravening certain provisions. Additionally, companies may face administrative penalties and reputational damage that could affect their operations and market standing. The Act ensures that the nominated carrier’s duties are taken seriously, with stringent measures in place to enforce compliance.
