Overview

The Telecommunications Act 1997 was enacted to provide a comprehensive framework for regulating telecommunications in Australia. It addresses the need for effective and efficient regulation of telecommunications services and infrastructure, ensuring that consumers have access to high-quality services while fostering competition and innovation in the telecommunications industry. The Act was enacted by the Commonwealth Parliament and its policy objective is to promote the efficient operation of telecommunications services and infrastructure, and to protect the interests of consumers and other stakeholders. The Australian Communications and Media Authority (ACMA) is the regulatory body responsible for enforcing the provisions of the Act. In the context of the declaration for Opticomm Pty Ltd, the Act facilitates the designation of a nominated carrier for specific network units, ensuring that the carrier can meet its obligations and that the declaration does not impede the administration of the Act and related legislation.

Scope and Application

The Telecommunications Act 1997 governs telecommunications in Australia and applies to entities such as Opticomm Pty Ltd that provide telecommunications services. In this instance, the Act designates Opticomm Pty Ltd, with ACN 117 414 776 and holder of carrier licence number 239, as the nominated carrier for all network units owned by Sanctuary Cove Principal Body Corporate GTP 202 ABN 19 796 870 713 within the Sanctuary Cove Estate, Queensland. This declaration is specifically limited to the geographic coordinates detailed in the attachment, which uses the GDA94 geodetic system in Well Known Text (WKT) format. This declaration is made under the authority of the Australian Communications and Media Authority (ACMA) and is contingent on Opticomm Pty Ltd's ability to meet all obligations as a nominated carrier, without hindering the efficient administration of the Act, the Telecommunications (Consumer Protection and Service Standards) Act 1999, and related regulations. The declaration does not specify any exclusions, exemptions, or thresholds, nor does it mention any subordinate instruments that might extend or restrict its application.

Key Provisions

The primary operative section of the document is Subsection 81(1) of the Telecommunications Act 1997, which allows the Australian Communications and Media Authority (ACMA) to designate a nominated carrier for specific network units. In this instance, ACMA, through Dominic Byrne, has declared Opticomm Pty Ltd, ACN 117 414 776, as the nominated carrier for all network units owned by Sanctuary Cove Principal Body Corporate GTP 202 ABN 19 796 870 713, situated within the Sanctuary Cove Estate. The declaration was made based on the applicant's ability to comply with all obligations as a nominated carrier and the assurance that this action would not hinder the efficient administration of the Telecommunications Act 1997, the Telecommunications (Consumer Protection and Service Standards) Act 1999, or any regulations under that Act. As the designated nominated carrier, Opticomm Pty Ltd must fulfil specific obligations under its licence to ensure efficient and compliant telecommunications services within the designated area. These obligations include maintaining network quality, providing customer support, and adhering to the service standards set by ACMA. The company is also required to report any significant issues or changes in service to ACMA promptly. Additionally, Opticomm Pty Ltd must ensure that its operations do not impede the efficient administration of relevant telecommunications laws and regulations. Failure to comply with the obligations and requirements imposed by the Telecommunications Act 1997 and related regulations can result in various penalties and consequences. The Act provides for both civil and criminal penalties for non-compliance. Civil penalties may include fines up to a specified maximum amount, depending on the severity and nature of the breach. For instance, under the Telecommunications (Consumer Protection and Service Standards) Act 1999, the maximum penalty for contravening service standards can be significant, often expressed in penalty units, which are adjusted periodically based on the Consumer Price Index. Criminal penalties can include imprisonment, particularly for more serious offences such as fraudulent activities or deliberate interference with telecommunications services. The specific penalties are detailed in the respective sections of the Acts and regulations, and enforcement actions are taken by ACMA or other relevant authorities.
