Overview
The Telecommunications Act 1997, enacted by the Parliament of Australia, was introduced to establish a framework for the regulation of telecommunications services in Australia, ensuring efficient and effective communication networks are available across the country. The policy objective of this legislation is to facilitate the provision of telecommunications services while promoting competition and consumer protection. The Act addresses the problem of ensuring that telecommunications services are accessible, reliable, and of high quality, while also protecting consumers from unfair practices. As part of its regulatory functions, the Australian Communications and Media Authority (ACMA) has the authority to designate nominated carriers for specific network units, as seen in the declaration for Telstra Limited concerning network units owned by Mineral Resources Limited. This declaration ensures that Telstra Limited is recognised as the nominated carrier for the specified network units, thereby enabling the provision of 4G mobile services to the Kens Bore Camp, while ensuring compliance with the obligations set out in the Act and related consumer protection legislation.
Scope and Application
The Telecommunications Act 1997, through its subsection 81(1), governs the designation of a nominated carrier for specific network units. In this instance, the Australian Communications and Media Authority (ACMA) has declared Telstra Limited as the nominated carrier for the microwave radio links owned by Mineral Resources Limited, connecting several sites in Western Australia. This declaration is contingent on Telstra’s compliance with all obligations associated with its role as the nominated carrier, including ensuring the provision of 4G mobile services to the Kens Bore Camp. The declaration ensures that the nominated carrier is positioned to fulfil its duties without hindering the efficient administration of the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999. The geographical scope of this application is limited to the specified sites within Western Australia, ensuring that the telecommunications infrastructure supporting Telstra’s public mobile network operates within the designated parameters.
Key Provisions
The Telecommunications Act 1997, through Subsection 81(1), allows the Australian Communications and Media Authority (ACMA) to designate a nominated carrier for specific telecommunications network units. In this instance, Telstra Limited has been granted this status by a delegate of the ACMA, Dominic Byrne, on 17 January 2023. The declaration pertains to Telstra's role as the nominated carrier for network units owned by Mineral Resources Limited, which include microwave radio links connecting various sites in Western Australia (subsection 81(1)(a)). This designation is made on the condition that Telstra can fulfil its obligations as the nominated carrier without hindering the efficient administration of the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999 (subsection 81(1)(b)).
Telstra, as the nominated carrier, will be required to ensure that its operations comply with all the statutory obligations set out in the Telecommunications Act 1997 and the associated regulations. This includes providing telecommunications services over the specified network units and maintaining the quality of these services as per the standards set out in the Telecommunications (Consumer Protection and Service Standards) Act 1999. The declared network units serve to carry communications to or from Telstra's public mobile telecommunications network and to provide 4G mobile services to the Kens Bore Camp. Telstra must also maintain the infrastructure of these network units and ensure that they are available for use as required by Mineral Resources Limited and other stakeholders.
Failure to comply with the obligations outlined in the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999 may result in significant consequences for Telstra. The specific offences and penalties are not detailed in the provided declaration but generally, breaches of these Acts can lead to civil or criminal sanctions. Civil penalties may include fines, and in severe cases, criminal penalties may apply, which can include imprisonment. The exact penalties would be determined based on the nature and severity of the breach, as well as any precedent set by previous cases under these Acts.
