Overview

The Telecommunications Act 1997 was enacted to regulate telecommunications in Australia and to provide a framework for the delivery of telecommunications services and infrastructure. The Act was introduced to address the need for a comprehensive legislative structure that would ensure the efficient and effective provision of telecommunications services across the country. The Act is administered by the Australian Communications and Media Authority (ACMA), which is tasked with enforcing compliance with the Act's provisions and overseeing the telecommunications industry. The policy objective of the Act is to facilitate the development of a competitive and innovative telecommunications market while ensuring that consumers have access to a range of services at reasonable prices. The Act also seeks to promote the efficient use of the radio spectrum and other telecommunications resources. The declaration by Dominic Byrne, a delegate of ACMA, recognises Telstra Limited as the nominated carrier for specific network units owned by Atlas Iron Pty Ltd, facilitating the delivery of communications services to and from Telstra’s public mobile telecommunications network and providing 4G mobile services to Sanjiv Ridge Camp. This declaration ensures that Telstra is well-positioned to comply with all obligations under the Act and related legislation, thereby supporting the efficient administration of telecommunications in Australia.

Scope and Application

The Telecommunications Act 1997, under subsection 81(1), applies to Telstra Limited, which has been designated as the nominated carrier for the network units owned by Atlas Iron Pty Ltd. This legislation designates Telstra Limited, holder of carrier licence number 582, as the nominated carrier for specific network units which include a microwave radio link connecting Telstra’s Marble Bar Radio Terminal in Western Australia to Atlas Iron's Sanjiv Ridge Mine Tower and communications equipment building at the Sanjiv Ridge Mine Camp. This designation is specifically for carrying communications to or from Telstra’s public mobile telecommunications network and for providing 4G mobile services to the Sanjiv Ridge Camp. The legislation applies within the jurisdiction of the Commonwealth of Australia, ensuring compliance with obligations set out in the Telecommunications Act 1997 and the Telecommunications (Consumer Protection and Service Standards) Act 1999. The declaration by the delegate of the Australian Communications and Media Authority, Dominic Byrne, on 14 December 2022, confirms that Telstra Limited is able to meet these obligations and that the declaration will not impede the efficient administration of relevant Acts and regulations.

Key Provisions

The declaration in Subsection 81(1) of the Telecommunications Act 1997 (the Act) grants Telstra Limited, identified by the Australian Company Number (ACN) 086 174 781 and carrier licence number 582, the status of a nominated carrier for specific network units. This designation allows Telstra to provide essential telecommunications services to Atlas Iron Pty Ltd’s Sanjiv Ridge Mine, connecting the Telstra demarcation point at Marble Bar Radio Terminal in Western Australia to the mine tower and the communications equipment building at the Sanjiv Ridge Mine Camp. This includes facilitating communications to or from Telstra’s public mobile telecommunications network and providing 4G mobile services to the mine site. The declaration is predicated on the assumption that Telstra is capable of meeting all obligations as a nominated carrier without hindering the efficient administration of the Act and related consumer protection legislation. Telstra, as the nominated carrier, is required to adhere to a comprehensive set of obligations to maintain the integrity and efficiency of the telecommunications services provided. This includes ensuring that the network units operate within the parameters set by the Act and associated regulations, which might involve specific technical standards and service delivery requirements. Telstra must also ensure that its operations do not compromise the efficient administration of the Act and the Telecommunications (Consumer Protection and Service Standards) Act 1999, which includes maintaining service standards and protecting consumer rights. Additionally, Telstra must comply with any specific conditions or directives issued by the Australian Communications and Media Authority (ACMA) related to the network units in question. Breach of the obligations imposed by the Act or failure to comply with the terms of the declaration can result in significant consequences. Under the Act, non-compliance can lead to enforcement actions by ACMA, which may include fines, public reprimands, or even the suspension or revocation of the carrier licence. The severity of the penalties depends on the nature and extent of the breach. For instance, serious or repeated violations might attract higher fines, while less severe breaches could result in lesser penalties. It is essential for Telstra to diligently adhere to the requirements to avoid these repercussions and to ensure the continued provision of reliable telecommunications services to Atlas Iron Pty Ltd.
