Overview
Statutory Rules 1973 No. 213, enacted under the authority of the Governor-General and with the advice of the Executive Council, constitutes the Regulations under the Nitrogenous Fertilizers Subsidy Act 1966-1972. The primary objective of these regulations is to amend existing provisions to modernise the language and units of measurement used within the legislation, ensuring consistency with contemporary standards. Specifically, these regulations rectify anachronistic terminology by replacing the term "tons" with "tonnes" in relevant applications for subsidy, thereby aligning the regulatory framework with current international practices. This legislative instrument aims to address any ambiguity or confusion that may arise from outdated measurement units, facilitating clearer and more precise administration of subsidies under the Act.
The enactment of these regulations was driven by the need to update and refine the legislative framework governing nitrogenous fertilizers subsidies, ensuring that the language and metrics used within the regulations are current and unambiguous. By amending and repealing certain regulations, the legislative instrument seeks to enhance the clarity and effectiveness of the subsidy application process, thereby supporting the overarching policy objective of the Act to promote the efficient and equitable distribution of subsidies for nitrogenous fertilizers within Australia.
Scope and Application
The Nitrogenous Fertilizers Subsidy Regulations 1973, made under the authority of the Nitrogenous Fertilizers Subsidy Act 1966-1972, apply to entities involved in the manufacture, importation, or distribution of nitrogenous fertilizers within Australia. These regulations govern the processes and criteria for subsidy applications, ensuring that entities eligible for subsidies under section 5 of the Act adhere to the prescribed conditions. The geographic scope of these regulations is national, extending to all states and territories within the Commonwealth of Australia, thereby providing a uniform framework for subsidy applications across the country. The regulations do not specify particular exclusions or exemptions; however, they do include amendments to reflect contemporary terminology, such as substituting "tonnes" for "tons" to align with standard international usage. Any further extension or restriction of the application of these regulations may be made through subordinate instruments, which would be notified in accordance with the legislative process.
Key Provisions
The Statutory Rules 1973 No. 213, made under the Nitrogenous Fertilizers Subsidy Act 1966-1972, primarily focus on amending the Nitrogenous Fertilizers Subsidy Regulations. The key operative sections include Regulation 4, which has been amended to replace the term “tons” with “tonnes” (section 1(1)). Additionally, Regulation 5 has been repealed entirely (section 2). These changes reflect a straightforward update to the terminology used in the regulations, ensuring consistency with the metric system.
The amendments impose specific obligations on parties involved in applications for subsidies under section 5 of the Act. By replacing “tons” with “tonnes,” the regulations clarify and standardise the unit of measurement for nitrogenous fertilizers. This change necessitates that all future applications and related documentation must now use the term “tonnes” (section 1(1)). Furthermore, with the repeal of Regulation 5, any previous requirements or stipulations contained within that regulation are no longer applicable (section 2).
In terms of consequences for non-compliance, the regulations do not explicitly detail any specific offences, penalties, or consequences for breaching the amended provisions. However, under the broader framework of the Nitrogenous Fertilizers Subsidy Act 1966-1972, failure to adhere to the prescribed regulations could potentially lead to legal repercussions. Such consequences might include fines, revocation of subsidies, or other administrative penalties as outlined in the principal Act. The precise penalties would depend on the nature and severity of the non-compliance, as well as any additional provisions within the overarching legislation.
