New South Wales Heavy Vehicle Standards (Rear-Loading Waste Collection Vehicle) Exemption Notice 2022 (No.1)

 

  1. Purpose

 

The purpose of this notice is to exempt a heavy vehicle to which it applies from certain requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).

Note: This Notice replaces the New South Wales Heavy Vehicle Standards (Rear-Loading Waste Collection Vehicle) Exemption Notice 2017 (No.1).

 

This is not an authorisation to access the road network, you may need to comply with the relevant Guidelines/Notices in New South Wales or apply for a permit if the masses or loaded dimensions exceed the limits in the Regulations, Guidelines/Notices in New South Wales.

2.       Authorising Provision

 

This notice is made under section 61 of the Heavy Vehicle National Law (the National Law) as in force in New South Wales.

 

3.       Title

 

This Notice may be cited as the New South Wales Heavy Vehicle Standards (Rear-Loading Waste Collection Vehicle) Exemption Notice 2022 (No.1).

 

4.       Commencement

 

This notice commences on 13 June 2022.

 

5.       Expiry

 

This notice expires on 12 June 2027.

 


6.       Definitions

 

1)      Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.

 

2)      In this Notice—

Rear-loading waste collection vehicle means a vehicle designed and constructed to collect waste by a bin lifting mechanism at rear of the vehicle.

 

7.       Application

 

1)      This notice applies to a rear-loading waste collection vehicle.

 

2)      This notice applies in New South Wales.

 

8.       Exemption from Prescribed Vehicle Standards

 

1)      A rear-loading waste collection vehicle is exempt from complying with Schedule 2 Section 34(1) of the National Regulation, in so far as it requires compliance with the following prescribed dimension requirement:

 

a)      Schedule 6 Section 5(1) Length—rear overhang of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the MDL Regulation).

9.       Conditions

 

1)      The rear overhang of a rear-loading waste collection vehicle must not be more than the lesser of:

 

a)      90% of the vehicle’s wheelbase; or

b)      4.0 metres

 

2)      If fitted with a step for use when collecting waste that makes the vehicle over dimension, the step must be designed and fitted so that it is able to be folded so the vehicle is within regulation dimension limits, or does not extend beyond another fixed component of the vehicle.

3)      A step as described in (2) must be folded when not in use.

4)      When engaged in waste collection, the vehicle must have its low beam headlights or daytime running lights on.

 

5)      A warning light must be fitted to the vehicle and switched on whenever the vehicle is engaged in waste collection.

 


6)      When switched on, a warning light mentioned under (5) must:

 

a)      be clearly visible at a distance of 500 metres in all directions; or

b)      be supplemented by 1 or more additional warning lights so that the light emanating from at least 1 of them is clearly visible at a distance of 500 metres in any direction; and

c)       not be a strobe light; and

d)      emit a yellow coloured light of rotating and flashing effect; and

e)      flash between 120 and 240 times a minute; and

f)        not be of an intensity that is likely to dazzle another road user.

Additionally, when engaged in waste collection, the vehicle must have its low beam headlights or daytime running lights on (section 9(4)), and a warning light must be fitted and switched on whenever the vehicle is engaged in waste collection (section 9(5)). This warning light must be clearly visible at a distance of 500 metres in all directions or be supplemented by additional warning lights to achieve the same visibility (section 9(5)(a) and (b)). It must not be a strobe light, emit a yellow coloured light of rotating and flashing effect, flash between 120 and 240 times a minute, and not be of an intensity that is likely to dazzle another road user (section 9(5)(c) to (f)). The obligations imposed on parties by this Notice are primarily related to compliance with the conditions outlined in section 9. Owners or operators of rear-loading waste collection vehicles must ensure that their vehicles meet the specified dimension requirements and that any steps fitted for waste collection can be folded as required. They must also ensure that the vehicle has its low beam headlights or daytime running lights on and a warning light fitted and switched on whenever the vehicle is engaged in waste collection. These lights must meet the visibility and intensity requirements specified in the Notice. Failure to comply with these conditions could result in the vehicle being non-compliant with the National Regulation and potentially subject to enforcement action. Breaches of the conditions outlined in this Notice may result in civil or criminal penalties. However, the Notice itself does not specify the exact penalties or consequences for non-compliance. Instead, it refers to the Heavy Vehicle National Law (the National Law) under which it is made. Under the National Law, breaches of vehicle standards regulations can result in fines and other penalties, including the impounding of the vehicle. The specific penalties for breaches of this Notice would be determined in accordance with the provisions of the National Law and any relevant guidelines or notices in New South Wales. It is important for parties to be aware of their obligations under this Notice and to ensure compliance to avoid potential penalties.
